Joseph succi, Deceased/ Ashtabula W.C . Claim Date of Death 1-10-89
On January 31, 1991 the Industrial Commission of Ohio approved a full and final lump sum settlement of the above captioned claim in the amount of $ 49,500.00.
You may recall that Dorothy Succi's claim for death benefits had been allowed at the first administrative hearing as a result of three physicians opining that Joseph's occupational disease, diagnosed as angiosarcoma, was directly and causally related to his employment at Ashtabula and his exposure to vinyl chloride.
The District Hearing Officer gave little weight to our toxicologist's report, which in effect stated that in the absence of exposure data no physician could "fairly" establish work relatedness .
We appealed the decision, staying payment of benefits, and proceeded to negotiate a settlement with Dorothy and her legal counsel in the amount of $ 39,500.
Historically, the Industrial Commission frowns upon settling "allowed" death claims and I fully expected that they would not agree to approve this one. Fortunately, I was able to convince both the widow claimant, her counsel and the Commissioners that we were serious about this matter and that an appeal to court was virtually guaranteed and in no one's best interest.
At the formal settlement hearing the "new" chairman of the
Commission inquired as to whether or not the company could "do a
little more..." for the widow. I was prepared and offered to
increase the settlement by $ 10,000.
It was immediately and
unanimously approved.

Upon receipt of the formal ''Record Of Proceedings", payment will be made.
Based upon the widow's life expectancy, the settlement saved GenCorp roughly $ 221,000 and removes the Succi case from our "Potentially Costly Claims List".
Self-insurance and self-administration enhanced our claims management activities, enabling original denial of her claim, controlled defense preparation and the ability to posture for a very favorable settlement.
