The fuel at this Facility is sold to the public. The Environmental Protection Agency's records indicate that the Facility has Four steel underground storage tanks (UST), which were installed in 1989. The first tank (Tank 1) is 1,000 gallons and contains premium unleaded. The second tank (Tank 2) is 1,000 gallons and contains regular unleaded. The third tank (Tank 3) is 1,000 gallons and contains Centex Roadmaster premium diesel. The fourth tank (Tank 4) is 1,000 gallons and contains red dye diesel fuel for offroad and agricultural use. The Facility piping is a European safe suction system with single-walled, fiberglass reinforced plastic (FRP) construction. Inspection Narrative On September 27, 2023, the EPA UST program personnel conducted an inspection at Farmers Union Oil in Selfridge, North Dakota. The EPA last inspected the Facility on November 2, 2020, and it was selected for routine reinspection. On September 19, 2023, Andy Woodward spoke to the Facility manager to schedule the inspection and asked for a list of UST documents to be available for the inspectors to review (see Attachment A). 3040003 - FUO in Selfridge Page 1 of 3 9/27/2023 UST Inspection The EPA inspectors arrived at the Facility at approximately 8:30 a.m. Central Daylight Time (CDT). Mr. Woodward introduced himself and presented his inspector credentials. He filled out a Notice of Inspection (NOI) (see Attachment B) and requested a signature. Mr. Woodward explained that the NOI serves as documentation of consent for the EPA to conduct an inspection. He stated that he would provide the NOI to them at the end of the inspection. The EPA inspectors began with a review of the Facility UST records followed by a physical inspection of the UST system. EPA inspectors took photographs of the UST system components during the inspection (see Attachment C). A Facility representative assisted with the physical inspection. Tank Leak Detection Tank leak detection consists of a new Franklin Fueling EVO-550 automatic tank gauge (ATG) system installed August 10, 2021, by Hobbs Inc. Facility representatives provided twelve months of printouts from the system console for all four tanks. Passing tank leak detection tests from September 2022 through September 2023 were physically observed. At the time of inspection, the annual operability test for the ATG was not available. Piping Leak Detection The Facility's piping is equipped with a European safe suction system using FRP piping. Cathodic Protection The facility uses a sacrificial anode cathodic protection system for the steel tanks. The piping is fiberglass reinforced plastic (FRP) and does not require cathodic protection. Documentation for the last two cathodic protection tests were on July 10, 2021, and July 13, 2018 (see Attachment D). Periodic Testing/Inspection of Spill and Overfill Prevention Equipment Current documentation of the passing triennial spill bucket tests is dated January 4, 2021. A new spill bucket for Tank 1 premium unleaded was installed September 7, 2021. New overfill alarms for each tank were installed August 10, 2021, at the same time of the new EVO-550 console. All work completed by Hobbs Inc. Periodic Operation & Maintenance (O&M) Walkthrough Inspections The facility uses the North Dakota monthly and annual walkthrough inspections checklist documenting the last 12 months at the time of inspection. Operator Training The Facility provided class A/B operator training for the primary facility representative at the time of inspection. No record of class C operators was current and documented. 3040003 - FUO in Selfridge Page 2 of 3 9/27/2023 UST Inspection Financial Responsibility The Facility is currently registered with the North Dakota Department of Environmental Quality (DEQ). The facility provided a completed North Dakota Certificate of Registration for the Petroleum Tank Release Compensation Fund for facility #1274, valid through August 1, 2024. Physical Observations EPA inspectors viewed the spill buckets, overfill alarms, safe suction pump systems inside of dispensers, automatic tank gauges, vent lines, and ATG console. All appear to be functional and intact. Conclusion At the conclusion of the inspection, Ms. Grabowski notified the facility that it was out of compliance and filled out an Onsite Deficiency Identification Form (see Attachment E), addressing the areas of noncompliance and the recommended corrective actions required to be taken. These items were identified from the inspection checklist (see Attachment F). Mr. Woodward completed the NOI form and the facility representative signed and received a copy. The Facility representative supplied proof of the spill bucket testing after this form was completed, therefore this item is no longer required.
