TITLE: EMPLOYEE MEDICAL EXAMINATIONS - ASBES AFFECTINC: SL'EPART C SECTION 1910.93a (j ) (6) (lj April 18, 1973 Tlie referenced standard requires EMPLOYERS to provide or make available, at no cost to the employee, medical examinations for employees in occu pations exposing them to airborne concentrations of asbestos fibers. EMPLOYEES are not required to take the examination under the asbestos standard. In the event an employee refuses to take a medical examination, it should be determined if the employer made a good faith offer. OSHA states if such determination is favorable, the employer shall be deemed in compli ance with the regulations. Statement of refusal, signed by the employee, to the effect he will not Cake a physical examination will be considered appropriate for complying with the medical record requirements under this standard. All medical records concerning this standard must be maintained by employ ers for at least twenty (20) years. This clarifying policy was issued by OSHA under a directive dated March 16, 1973.
