Environmental Protection Agency Region 4 Air Enforcement Branch 61 Forsyth Street, SW Atlanta, Georgia 30303 INSPECTION REPORT Facility Inspected Burger King 1022 Maddox Drive Ellijay, Georgia 30540 Inspection Date: July 19, 2022 Facility Programmatic ID 3601452490 LAT: 34.6769 LON: -84.4780 Inspection Type Clean Air Act (CAA) National Emission Standards for Hazardous Air Pollutants (NESHAP) - Asbestos Inspectors Pamela Storm (lead inspector) Tony Spann (Inspector-in-Training) Introduction An inspection pursuant to Section 114 of the CAA was conducted on July 19, 2022, at Burger King located at 1022 Maddox Drive in Ellijay, Georgia 30540 (the facility). The unannounced inspection was conducted by Pamela Storm who possesses EPA inspector credentials to conduct CAA NESHAP asbestos inspections and Tony Spann. Mr. Spann also possesses EPA inspector credentials and was participating in this inspection to meet training requirements to conduct CAA NESHAP asbestos inspections. The facility is a fast-food restaurant. Permit #22-2690 was obtained from the City of East Ellijay on June 10, 2022, for the repair (renovation) of the facility following storm damage which occurred on February 14, 2022. Renovations had been completed at the time of this inspection. The purpose of the inspection was to determine compliance with the CAA NESHAP Asbestos Standard and the regulations promulgated at 40 CFR Part 61, Subpart M, for the renovation activity conducted pursuant to this permit. The EPA Region 4 CAA NESHAP asbestos program targets facilities for inspection located in the State of Georgia based on tips/complaints; permits issued on a local level; and demolition and/or renovation/abatement notices sent to the State. This inspection was conducted based on the previously mentioned permit. Facility Information The facility is a fast-food restaurant. Inspection Inspection Inspectors met with Robert Halliburton, General Manager, upon arrival at the facility. Inspectors presented their inspector credentials and explained that EPA was conducting the routine oversight inspection of the permitted renovation activity for compliance with the Asbestos NESHAP. Mr. Halliburton said he did not know if an asbestos inspection was conducted prior to the renovations. He provided the name and phone number for Michelle Debore (912-687-3129) who he said owned the facility and could provide more information. I spoke with Ms. Debore on August 2, 2022, who referred me to Marcia Brock, Director of Operations, for more information about the renovations. Renovation activity was not occurring at the facility at the time of this inspection. Permitted renovations were completed on or around July 4, 2022. Conclusion The inspectors will follow up with the owners/operators of the facility and the renovation activity, as deemed appropriate, to obtain information and necessary paperwork related to this renovation activity. This information will include, but not necessarily be limited to, copies of asbestos inspection reports, renovation notifications, and waste shipment records for the facility.
