PLAINTIFF'S EXHIBIT / ' -V . Sealy WARNING LABELS ON BRAKE PACKAGING a J. H. Sherr June 3, 1980 cc: W. C. Burkhead W. N. Bockay C. J. Hunter J. S. Kublak It Is true that under 29 CFR S 1910.1001(g)(2), there Is probably no requirement to Include caution labels where there Is no foreseeable use which will create dust. The section states: "Caution labels. (1) Labeling. Caution labels shall be affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or to their containers, except that no label Is required where asbestos fibers have been modified by a bonding agent, coating, binder or other material so that during any reasonably foreseeable use, handling, storage, disposal, processing, or transportation, no airborne concentrations of asbestos fibers In excess of the exposure limits presented In paragraph (b) ol* - this section will be released.1* ~ JK I would urge, however, that labels be retained since such labels would be helpful In the defense of a product liability action even If they were not required under OSHA. Please advise If any action Is to be taken to remove caution labels from packages. JHSzps ji'1. I
