Main Beaver, OK 73932 at 9:14 a.m., on March 25, 2024, for an unannounced inspection. Inspector was joined by Mr. David Jett of ODAFF as this was a joint inspection with EPA lead. Inspector met with Mrs. Jeri Slatten (Office Manager) at the Opening Conference. Inspectors presented their credentials to Mrs. Slatten and informed her that this was an EPA inspection to determine the facility's compliance status with the Concentrated Animal Feeding Operation (CAFO) regulations as authorized by Clean Water Act (CWA) Section 308. The scope of the inspection included a compliance evaluation of the facility's site operations and record keeping determining the designation of the facility as a CAFO. The government vehicle was parked in the parking lot outside the facility office and the inspection was performed in a company vehicle. Inspectors were accompanied by Mr. Jeff Slatten (Owner). FACILITY DESCRIPTION Beaver County Stockyards reported that they have sold a total of 133,807 combined cattle in 2023 for a total of 49 sales averaging 2730 head a sale. They only sell beef cattle. Auctions are held Tuesday and Wednesday every week unless it is a holiday. Animals are housed for around 24-72 hours for each sale. Animals are housed in open lot pens (Appendix 1, Photo 1). The facility borders Beaver River on the north edge (Appendix 1, Photos 2 & 3) (Appendix 2, Photo 1). Vegetated strips and some berms make up the perimeter of the north edge between the river and the pens (Appendix 1, Photos 8-10). Pens are cleaned via scraping using a front loader which is done as needed. Lot scrapings are then stockpiled before being hauled off site (Appendix 1, Photos 6 & 13). Mortalities are hauled off and landfilled same day when needed. The livestock market uses hay. These commodities are stored in bales on the northern and eastern part of the facility (Appendix 1, Photos 6-7, 11 & 13). Section II - OBSERVATIONS Beaver County Stockyards has the requirements to meet the large CAFO regulatory definition. It was snowing during the entirety of the inspection. The open lot pens were clean and without any visible manure piles inside the pens. There were a few visible manure stockpiles outside the pens without any runoff prevention control (Appendix 1, Photos 6 & 13) (See Areas of Concern). There is a vegetative strip running along most of the northern and eastern edge of the facility (Appendix 1, Photo 10). There is a culvert on the north end of the facility that collects runoff from the pens to the south and has a drainage channel to the Beaver River (Appendix 1, Photos 11-12) (See Areas of Concern). There is also a culvert on the east end of the facility that collects runoff from the pens, manure stockpiles, and hay bales and has a drainage channel to the Beaver River (Appendix 1, 13-15) (See Areas of Concern). No other potential issues were found during the inspection. Section III - AREAS OF CONCERN 1) There were manure stockpiles without any runoff prevention control. (Agriculture Pollutant Discharge Elimination System General Permit for Discharges from Concentrated Animal Feeding Operations in Oklahoma Part II.A.2.b.vii.: "There shall be no discharge of rainfall runoff from manure or litter storage piles.") 2) There is a culvert on the north end of the facility that collects runoff from pens with a drainage channel to the Beaver River. (Agriculture Pollutant Discharge Elimination System General Permit for Discharges from Concentrated Animal Feeding Operations in Oklahoma Part II.A.1: There shall be no discharge of manure, litter, or process wastewater pollutants into waters of the United States from the production area...") 2 Beaver County Stockyards Inspection Date 03/25/2024 3) There is a culvert on the east end of the facility that collects runoff from the pens, manure stockpiles, and hay bales with a drainage channel to the Beaver River. (Agriculture Pollutant Discharge Elimination System General Permit for Discharges from Concentrated Animal Feeding Operations in Oklahoma Part II.A.1: There shall be no discharge of manure, litter, or process wastewater pollutants into waters of the United States from the production area...") There were no other areas of concern at the time of the inspection. EPA Region 6 inspectors conducted a closing conference for the Beaver County Stockyards inspection at approximately 10:52 a.m. on March 25, 2024. During the closing conference, the inspectors reviewed findings with the Mr. Slatten. Inspector provided compliance assistance brochures and FAQ sheets to the office manager. Section IV - FOLLOW UP No follow up with the facility has occurred since the time of the inspection.
