CMA 061839 MINUTES OF MEETING MCA EXECUTIVE COMMITTEE Pinnacle Club, New York City November 24, 1975 Following lunch at 12:30 p.m. , the meeting was called to order by Chairman Hanley. Van Antwerpen Secretary, American Institute of Chemical Engineers Note: Messrs. Coulter and Van Antwerpen were present only for the portion of the meeting with which they are identified in these minutes. 1. Financial Raport for Five Months Ended October 31, 1975 Mr. Best reported the information shown in Exhibit A. 2. Litigation on Tank Car Mileage Compensation Mr. Hanley referred to the proposal distributed in advance with the tentative agenda con cerning collection of an additional $1 per tank car from member company tank car owners and lessees, anticipated to yield about $65, 000, with which to continue litigation in the interest of more equitable tank car mileage com pensation. He stated an analysis made within his company had confirmed a high potential benefit/cost ratio. It was agreed to recommend Board approval, and to present the matter for consideration at the Board meeting later today. CMA061840 2- - 3. Texas Chemical Council Request for Support on Photochemical Oxidant Problem Relating to Petrochemicals Mr. Driver told of MCA's November 10th meeting with representatives of the Texas Chemical Council, headed by Mr. John T. Files, TCC President, in which it was suggested by TCC representatives that the photochemical oxidant regulations proposed by EPA for application in Texas have national implications and thus justify support ive consideration by a broad-based trade association such as MCA. As a result of this meeting, Mr. Driver indicated MCA's Air Quality Committee would meet in Texas to consider with TCC what research and other constructive actions might be taken to develop pertinent information, recommendations from which will be presented at a future Executive Committee meeting. Meanwhile, exploration will go forward with EPA on a stay of the regulations, as well as liaison with the American Petroleum Institute in the latter's intended judicial challenge. 4. Impact on Industry of Compliance with Laws This item stemmed from the White House briefing for chemical industry executives on October 15 during which, pursuant to comments on the burden of compliance with environmental and occupational regulations, Mr. Robert O. Aders, Undersecretary of Labor, suggested that industry consider assessing the impact of all the laws with which it must comply. Mr. Driver reported having contacted the National Association of Manufacturers and the U.S. Chamber of Commerce and learned that no such overall study has ever been undertaken. The practicalities of obtaining significant results were then discussed, the consensus being that while exami nation of selected areas might be feasible and useful on occasion, a general appraisal would be very costly and of doubtful merit. 5. Toxic Substances Control Legislation Mr. Hanley announced the Executive Committee would meet in Washington on December 9 for a thor ough review of the current status of the pending toxic substances control legislation and planning for MCA's continuing attention to it. He requested Dr. Barnes to furnish Dow's list of existing statutes applying to hazardous materials, suggesting that this and any other available company papers be sent to Mr. Driver for distribution to committee members in advance of the meeting. Representatives of the Government Relations and Legal Advisory Committees and the Toxic Substances Control Group will be invited to attend. Mr. Driver reported that Mr. Russell Peterson, chairman of the Council on Environmental Quality, had not yet made himself available to re view the Snell economic impact study as he had agreed at the October 15th White House briefing, despite efforts to reach him for this purpose. It was agreed that a letter request should be sent to him by MCA's Board chairman to make this a matter of record. Mr. Driver indicated encouragement from a meeting of MCA and Snell representatives with GAO that GAO's criticism of the Snell study expressed CMA061841 -3- at Senate hearings on October 24 have been relieved. The actual outcome is expected to be revealed in a letter from GAO to Senator Tunney due by December 15. Mr. Driver mentioned OMB's endorsement of H. R. 7664 (McCollister) and EPA's response as to unsatisfactory features of this bill. He also spoke of MCA's continuing attention to drafting proposed versions of an industry bill, for which a further meeting has been scheduled on November 25. 6. Administrative Matters (a) West Coast Board Meeting (March 1976) Mr. Driver reported arrangement is under way for the Chairman of the Board of Standard Oil Company of California to be the guest speaker at this meeting, his ex pected subject to concern moves to break up integrated oil companies. Mr. Connor suggested a presentation, also, on the California "initiative" on energy, possibly by Mr. T. G. Hughes (who heads the Arrangements Com mittee). (b) Epidemiological Study of Petrochemical Workers Mr. Driver told of our Occupational Health Committee's interest in an epi demiological study of petrochemical workers proposed by the American Petroleum Institute which is prepared to pay half of the roughly estimated $150, 000 first-year cost. He said a recommendation is under development, particularly regarding definition of the worker population to be covered and some indication of ultimate cost. (c) CBS - "American Way of Cancer" (October 15) Mr. Driver reported having learned that this showing received relatively little viewer interest, either by the public or at special presentations sub sequently for members of Congress. Concurrence was expresssed in taking no action to refute the misleading information it contained. (d) Charles S. Munson Regretful note was taken of Mr. Munson's absence due to illness, especially on this occasion because for so many years he has been on hand at the time of the Semiannual Meet ing. 7. Visitation with Representatives of the American Institute of Chemical Engineers As prearranged, Messrs. Coulter and Van Antwerpen were received for a presentation of AIChE current programs and objectives. After being introduced by Dr. Barnes, Mr. Coulter illustrated his remarks with a series of slides, and a folder of explanatory papers was distributed to those present. , confect: Jdhit<W.
