SECTION I - INTRODUCTION
Purpose of the Inspection
The purpose of the inspection was to determine compliance with the industrial stormwater requirements under 301 and 402(p) of the CWA and its implementing regulations found at 40 CFR Part 122.26. The inspection was unannounced and consisted of interviewing facility representatives, recording field observations, and taking photographs to document site conditions throughout the Facility at the time of the inspection.
Opening Conference
1) On February 7, 2023, U.S. Environmental Protection Agency (EPA) contractor, PG Environmental, conducted an unpermitted industrial facility stormwater inspection at Dutchland, Inc. located in Gap, Pennsylvania (Facility). Taylor Fontaine of PG Environmental, Ivy Koberlein of EPA Headquarters, and Monica Crosby of EPA Region III (EPA Inspection Team) met with the Facility representative. Taylor Fontaine displayed his Clean Water Act (CWA) credentials, and the EPA Inspection Team conducted an opening conference. The EPA Inspection Team explained the purpose of the inspection was to document the facility's industrial activity and any obligations to apply for a National Pollutant Discharge Elimination System (NPDES) Permit (Permit). At the time of the inspection, the Facility did not have coverage under the Permit.
Weather conditions at the time of the inspection were cloudy with temperatures of approximately 28 F. There was no precipitation during the inspection. According to precipitation data from the National Oceanic and Atmospheric Administration (NOAA)1, the Gap, Pennsylvania area received no rain the day before the inspection.

FACILITY'S OPERATION & PRODUCT DESCRIPTION
The Facility comprises approximately twenty-two (22) acres located on Highway PA-41 in the City of Gap, Pennsylvania. The Facility is bordered by private land to the north, forested land to the west and south, and Highway PA-41 to the east. According to the Facility representative, the Facility manufactures precast concrete tanks and specialized concrete products, mostly for the water and wastewater industries. Manufacturing operations were observed to occur inside/undercover while other industrial operations (e.g., loading/unloading, concrete washout, and storage of rebar, forms, and admixtures) occur outside and are exposed to stormwater. The Facility's batch plant was not in operation at the time of the inspection, and they were receiving concrete from another supplier. The Facility includes one (1) office building, three (3) manufacturing/industrial buildings, several buildings for material storage, one (1) vehicle maintenance shop, and uncovered storage areas. Aggregate and manufacturing materials (e.g., polyvinyl chloride (PVC) piping and steel rebar) are stored in the north, central, and west portions of the Facility, while the manufacturing operations occur in the south portion of the Facility.

SITE EVALUATION
Observations
The Facility has one (1) entrance off Highway PA-41 where trucks and forklifts load and unload products for distribution and sale. The Facility representative stated that the Facility stores and maintains semi-trucks for loading and unloading and has over forty (40) vehicles onsite.
According to the Facility representative, Facility industrial operations (concrete manufacturing) occur primarily indoors and are not exposed to stormwater. Outdoor operations include materials storage, and loading/unloading (refer to Appendix B, Photographs DSCN5079, DSCN5091, DSCN5118, DSCN5138, and DSCN5148).
The EPA Inspection Team observed machinery and industrial equipment to be housed inside (refer to Appendix B, Photographs DSCN5127 and DSCN5128).
The EPA Inspection Team observed covered and uncovered storage areas for industrial materials (e.g., wood, steel rebar, metal casing), (refer to Appendix B, Photographs DSCN5079, DSCN5091, DSCN5118,DSCN5138, DSCN5147, and DSCN5148).

Liquid Storage (e.g., Tanks, Liquid Storage Drums)
SITE EVALUATION
The EPA Inspection Team observed the following liquid storage tanks/drums at the Facility:
One (1) (275-gallon) tote and three (3) 1-gallon jugs of accelerating admixture located in the middle of the Facility (refer to Appendix B, Photograph DSCN5125 & DSCN5126) without cover or secondary containment.
Approximately six (6) 55-gallon drums of waste oil/coolant and gear fluid located inside the vehicle maintenance shop in the northern portion of the Facility (refer to Appendix B, Photograph DSCN5162).
A 750-gallon tank containing diesel for an onsite generator located in the southern portion of the Facility (refer to Appendix B, Photograph DSCN5185). There was no secondary containment around the tank; however, the EPA Inspection Team did not evaluate whether the tank was double walled. There was no spill kit evident in the vicinity of the tank.
Waste Storage/Disposal Areas (solid and/or hazardous)
The EPA Inspection Team observed three (3) dumpsters with lids used for general waste located in the middle of the Facility (refer to Appendix B, Photograph DSCN5137), and one (1) location used for concrete waste contained by concrete blocks on three sides in the western portion of the Facility (refer to Appendix B, Photograph DSCN5144).
The EPA Inspection Team also observed a three (3)-tiered earthen concrete washout areas in the north area of the Facility (refer to Appendix B, Photographs DSCN5152, DSCN5153, and DSCN5154).

As referenced above, the Facility had an earthern concrete washout area that contained three (3) setting bays in sequence, managing runoff through a tiered system. (refer to Appendix B, Photographs DSCN5153 and DSCN5154). The Facility representative explained that once the lowest tier fills, the Facility will dig out the washout materials and dispose offsite. There was a truck utilizing the washout area during the inspection. The EPA Inspection Team observed the following fuel storage tanks located outside in the middle of the Facility. The tanks were double-walled and uncovered (refer to Appendix B, Photograph DSCN5140).

These three (3) fuels storage tanks, in conjunction with the aforementioned six (6) 55-gallon drums containing waste oil/coolant, and the 750-gallon tote containing diesel equate to 2,380 total gallons for petroleum storage. He Facility does not have a management plan specifically designed for the stored liquid being discussed.

OUTFALL, STORMWATER DISCHARGE & RECEIVING WATER OBSERVATIONS
The EPA Inspection Team observed the following potential discharge locations that all convey stormwater to an unnamed tributary to Williams Run:

A PVC drainpipe, connected to at least three (3) catch basins located in the southeast portion of the Facility, that leads or connects to the adjacent woods (refer to Appendix B, Photograph DSCN5074).
Another PVC drainpipe, leads or connects to the south portion of the Facility (refer to Appendix B, Photograph DSCN5084). The Facility Representative did not know the source of stormwater that discharges through this pipe.
A drainage channel leads or is connected to a drainage swale in the southwest corner of the Facility leads to an adjacent drainage ditch (refer to Appendix B, Photographs DSCN5092, DSCN5097, DSCN5099, and DSCN5103). This drainage ditch connects to an unnamed tributary to Williams Run located to the south of the Facility.
There are several areas that appear to receive discharges (overland flow) along the west fence line (refer to Appendix B, Photographs DSCN5100 and DSCN5101).

SITE EVALUATION Catch basins located in areas of outdoor industrial activity, appear to
be connected to several headwalls/pipes that are located along the west perimeter of the facility (refer to Appendix B, Photographs DSCN5112 and DSCN5145).
The EPA Inspection Team observed several locations along the west fence line over the course of approximately fifty (50) feet where sediment and debris had migrated offsite through the chain link fence and towards an adjacent unnamed tributary to Williams Run (refer to Appendix B, Photographs DSCN5100 and DSCN5101).
None observed.
The EPA Inspection Team observed that a PVC pipe in the southeast portion of the Facility appears to be connected to the adjacent woods (refer to Appendix B, Photographs DSCN5074 and DSCN5075).
Description of general gradients/slopes onsite, all apparent discharge points, and discharge pathway from Facility to Receiving Water or MS4 (storm drains, channel, swale, ditches, driveway, pipes, & etc.)
Ground contours in in the middle and south portions of the Facility appear to be graded to a drainage swale, which connects to a drainage ditch. The drainage ditch connects with an unnamed tributary of Williams Run, located to the south of the Facility (refer to Appendix B, Photographs DSCN5083, DSCN5088, DSCN5089, and DSCN5090).
Ground contours along the west perimeter of the Facility appear to be graded towards the west fence line, which is adjacent to an unnamed tributary of Williams Run (refer to Appendix B, Photographs DSCN5091 through DSCN5096).
Ground contours in the north portion of the Facility appears to be graded to a stormwater basin located in the northwestern corner of the Facility. The Facility representative was unsure if this stormwater basin was connected to the local sewer system (refer to Appendix B, Photographs DSCN5149 and DSCN5150).
SECTION III - AREAS OF CONCERN
1) The EPA Inspection Team observed concrete manufacturing at the Facility, an industrial activity classified under SIC Code 3272 - Concrete Products, Except Block and Brick. a. Businesses classified under SIC Code 3272 are regulated under 40 C.F.R. 122.26 for stormwater discharges associated with industrial activity.

b. Concrete washout, steel rebar materials storage, and loading/unloading operations occur outside and are exposed to stormwater (refer to Appendix B, Photographs DSCN5153 and DSCN5154).
c. The Facility did not have coverage under a Permit at the time of the inspection.
2) The EPA Inspection Team observed what appeared to be stormwater discharge locations: a. A polyvinyl chloride (PVC) drainpipe connected to at least three (3) catch basins located in the southeast portion of the Facility connected to the adjacent woods (refer to Appendix B, Photograph DSCN5074). a. An additional PVC drainpipe that ends along the south portion of the Facility (refer to Appendix B, Photograph DSCN5084). b. A drainage channel connected to a drainage swale that is connected to an adjacent, unnamed tributary of Williams Run in the southwest corner of the Facility. (refer to Appendix B, Photographs DSCN5092, DSCN5097, DSCN5099, and DSCN5103). c. Several areas of along the western fence line (refer to Appendix B, Photographs DSCN5100 and DSCN5101). d. Catch basins located in areas of outdoor industrial activity, appear to be connected to several headwalls/pipes that are located along the west perimeter of the facility (refer to Appendix B, Photographs DSCN5112 and DSCN5145). These catch basins did not have any observable inlet protection best management practices (BMPs).
3) The EPA Inspection Team observed several locations along the west fence line where sediment and debris had migrated through the chain link fence and towards an adjacent drainage ditch that connects to an unnamed tributary of Williams Run (refer to Appendix B, Photographs DSCN5100 and DSCN5101).
SECTION IV - CLOSING CONFERENCE
After the site walk, the EPA Inspection Team met with the Facility Manager from Dutchland, Inc. for a closing conference and shared preliminary observations. The EPA Inspection Team reiterated that all preliminary observations discussed were not compliance determinations. Any and all preliminary observations shared were subject to further investigation by the EPA Inspection Team. Additional observations may be contained in this inspection report that were not identified at the time of the closing conference.
The inspection concluded at approximately 11:20 AM (EST).

Description
Unnamed tributary to Williams Run adjacent to the northwest part of the Facility. Excess stormwater runoff from the adjacent basin could be conveyed towards the unnamed tributary to Williams Run. It was unconfirmed if this is connected to the drainage ditch observed along the west Facility perimeter (refer to Photographs DSCN5092, DSCN5097, and DSCN5105).
