Grumbles May 19, 1989 SUPPLEMENTAL MINUTES/NOTES FROM MAY 3 GROUNDWATER MEETING WITH DEQ Following are supplemental notes to the official minutes of the meeting which were written by Gary Wojnowski. 1. The state had George Kramer and Maurice Lessaire present for the entire meeting. 2. Kramer suggested the Feasibility Study and Remediation Plan should be prepared as separate documents. 3. Having heard our presentation, Kramer observed that "...our objectives are understandable but wrong" and that we "followed EPA procedures but ignored state law" in the FS and Remediation Reports. In essence he was saying state law says if groundwater is contaminated you must clean it up. He didn't elaborate on the extent of this. 4. Kramer and Lessaire felt that the 80 foot aquifer must be further defined. 5. Kramer made it clear that clean-up plan approval was now a public process and that technical and risk-based plans often won't fly due to the emotional issues. Subsequently, he urged us to change our stated objectives for the FS to be: 1) Clean-up the groundwater, and 2) comply with the state law. 6. Further to the science issue, he stated "...you may have the right answer, but you got there the wrong way." 7. Kramer would be reluctant to take our FS to anybody above him with out the modifications as discussed. "Cost effective" shouldn't be an explicit factor in the reports or plan. 8. Kramer stated that in a remediation plan you "get points" for reuse of recovered material. Multiple Action Items were decided on by Vista and Conoco.
