Subject: NESHAP for Brick and Structural Clay Products Mr. Wehrum: In connection with a story that will reference the long history of these regulations, I'll be noting that you were at EPA when the 2003 standards were promulgated and are now representing the Brick Industry Association in the ongoing litigation surrounding the 2015 regulations. I just wanted to check on a couple of points: 1. As counsel at OAR from 2001 to 2005, what was your role in drafting/promulgating the 2003 NESHAP? 2. How do you respond to criticism from environmental groups that point to the D.C. Circuit's 2007 decision as evident that the 2003 NESHAP were inadequate? 3. Based on the ethics agreement on file with OGE, it appears that, if you win Senate confirmation to head OAR, you will be recused for one year from any involvement in the current litigation and/or other matters related to the 2015 NESHAP.
