FR.q.CTI{)N MATERIALS STANDARDS INSTITUTE, INC., E-210 ROUTE 114, PARAMUS, NEW JERSEY ' October 31, 1977 TO: ASBESTOS STUDY COMMITTEE SUBJECT: Membership on the Committee and a question on the possibility of product recalls by the Consumer Product Safety Commission 07652 COMMITTEE MEMBERSHIP This is to advise the Committee that Mr. James Armstrong, Corporate Director of Safety and Protection Services for the Bendix Corporation was invited to serve on this Committee. Mr. Armstrong has accepted this invitation. This move was made to add additional members to the Committee with different expertise and concern in the asbestos area. In addition, I have been in contact with the Johns-Manville Corporation concerning the possibility that someone from J-M might help this Committee. I recently talked with Mr. Jim Reis of Johns-Manville Sales Corporation. Please see copies of letters from Mr. Armstrong and Mr. Reis. After I have met with Mr. Reis I will talk to the Chairman about a meeting. CONSUMER PRODUCT SAFETY COMMISSION I am enclosing a notice that I sent to the Officers and Board of Directors as regards a discussion I had with Mr. Adrian Comins of Auto Friction Corporation several weeks ago. Mr. Comins is concerned on procedures mandated by the Consumer Product Safety Commission when they propose or implement a product recall. While the Consumer Product Safety Commission has not specifically addressed asbestos brake linings as such, they have proposed a ban on the use of asbestos in patching compounds and in emberizing materials. The specific procedures for recall are spelled out in the act which set up the Consumer Product Safety Commission. Mr. Comins is concerned that if they do propose a ban on the use of asbestos containing friction materials that the friction material manufacturer will be the big loser because all products in the fi@ld can be returned for full credit. Mr. Comins has written directly to the Consumer Product Safety Commission concerning their recall procedures. He did this not as a member of the Institute or as an Officer of Auto Friction Corporation but as a private citizen on his own letterhead. He discussed the procedures which were used for the TRIS recall as a guide. After review of Mr. Comins comments Mr. Messier called and suggested that I send copies of this information to the Asbestos Study Committee for their consideraltion.- I am forwarding this memo to you for your review and it will be an agenda item at the next meeting of the Asbestos Study Committee meeting. If someone in the meanwhile wished to give some suggestions on this subject their suggestions would be most welcome. E. W. As I mentioned to you, we too, are concerned about government actions which may directly effect the friction materials industry. It is in the industry's interest to develop and implement work practices that adequately protect the worker before the governmnet steps in with its own regulations. We feel organizations such as FMSI are best suited to carry out this task. I cannot tell you, at this time, who will be J-M's representative to the committee or whether J-M will become an FMSI member. However, when you schedule your next Asbestos Study Committee meeting, someone from J-M will be present. I will contact you to arrange a mutually convenient meeting date the next time I am in the New York area.
