J. Olguin reviewed the purpose of the meeting. The addition of two agenda items, budget approvals in the Risk and Product Stewardship Focus Area, were approved. 2. The minutes of the October 20,1993, meeting were approved without changes. 3. The Committee approved canceling the December meeting. In addition, the Committee will try a schedule of meeting on alternate months, with conference calls held as needed on the off months. This tentative schedule will provide for meetings in January, March and May. All HSC members are expected to reserve the off-month as a potential meeting date, in case Committee business dictates the need for a meeting. Meeting rimpg will also be extended to allow for more business to be conducted at each session. 4. The Spring Open Meeting for 1994 will be canceled in lieu of the TSCA and OSHA Information Forums and other workshops being held under the HSC. However, the HSC asked the Management Review Team (MRT) to evaluate communication needs of member companies, especially those that benefit from a more general discussion of issues. The need for an Open Meeting will be re-evaluated next year pending member interest and the recommendations of the MRT. 5. G. Capaldi reviewed the budget prioritization process recommended by the Steering Task Group. The intent of this process is to provide the needed flexibility to adjust the budget if the allocated funding is less than anticipated. If the total funding provided is up to $315,000, Focus Areas will be asked to reduce their overall allocation by 23%, the exact process being determined by the individual Focus Area. If the allocation is less than that, certain Group II projects were prioritized and designated as below-the-line. These projects will have to be approved by HSC for funding in the 94/96 fiscal year. 6. S. Tirey led a discussion regarding an upcoming November 30 meeting with the American Industrial Hygiene Council (AIHC). The objective of the meeting will be clarify the respective roles and reduce redundancy of activities between the organizations, especially on risk. At that time each group will review its roles, objectives, strengths and weakness and try to develop a process for ongoing coordination. Additional comments should be provided to S. Tirey. 7. Risk Focus Area: Terry Wharton, Air Products, was introduced as the loaned executive for risk issues. Dr. Wharton will be devoting full time attention over two years to implementation of the risk principles. D. Sigman reported on the proceedings of the comparative risk workshop. The goal is to develop peer-reviewed criteria for assessing the validity of comparative risk studies. A draft of the criteria is expected to be completed in December, 1993. A request to shift $10,000 from the Executive Leadership Group briefings to support the Chemical Industry Council in monitoring a comparative risk project being carried out by the state of California was approved. CMA061189 Health and Safety Committee November 17,1993, Minutes Page 3 A request to shift $10,000 from the Executive Leadership Group briefings to support a National Academy of Sciences risk characterization study was approved. A request to provide $10,000 to develop advocacy outreach materials based on the risk principles was approved. These funds will be re*directed from a non-cancer endpoint methodology evaluation. A second Reference House Workshop is being developed by the Exposure Assessment Task Group. The Superfund Health Risk Assessment Task Group has completed three of five position papers on Superfund site assessments. The Ecological Risk Assessment Task Group provided technical input for the TSCA 8(e) comments. TbiB subject area (ecological risk assessment) should be included in the upcoming discussions with AIHC. The Risk Assessment Task Group is coping with severe member resource needs. This subject area is also relevant to discussions with AIHC. The House dropped the Johnston Amendment in the EPA Cabinet Elevation bill. An Office of Environmental Risk iB proposed in its place. Risk overall is receiving a high level of attention and activity in Congress. S. Tirey will be interviewed on the subject of DDT and breast cancer for an upcoming broadcast of Prime Time Live scheduled to air on December 9,1993. 8. OSH Focus Area K Pike provided an update on PROSPECT. The board deferred action on the proposed measurement system pending resolution of several issues, including property damage reporting thresholds and an appropriate list to define the scope of reporting. The system was discussed and comments offered on a number of issues, including the need to normalize data according to production volume. Members with further comments and concerns are urged to convey these to their representatives on the Engineering and Operations Committee (EOC). HSC members who do not have direct representation on the EOC are encouraged to submit their comments in writing to DHelin before December 8,1993. The Employee Health and Safety Code Implementation group is currently reexamining its mission and role. The Safety Programs Task Group is moving forward on the development of contractor safely and incident investigation guides. Joe Dear has been confirmed as Administrator of OSHA (Assistant Secretary of Labor). An OSHA Information Forum will be scheduled for January 18 or 20,1994. Mr. Dear will be a featured speaker at this kickoff Forum. CMA061190 Health and Safety Committee November 17,1993, Minutes Page 4 9. Product Stewardship Focus Area J. Quance provided a detailed overview of the joint CMA/SOCMA/EPA Use/Exposure Information project. This project provides benefits to both manufacturers as well as EPA. A preliminary pilot has been successfully completed. Outstanding issues remain to be resolved, however, with respect to the submission of Confidential Business Information (CBI). Manufacturers wish to provide CBI in order to supply the Agency with more accurate information, while EPA is struggling to make the maximum possible amount of information public. Other issues raised included redundant reporting under other statutes, with potential enforcement consequences, clarifying the instructions for providing process information, and providing additional guidance on how to format exposure information. The HSC approved moving forward with the next phase of the pilot. Final approval of the overall project will be provided pending resolution of the CBI issue. A funding request to cover a cost overrun on a contract for technical support on TSCA comments was not approved. A budget request to move $5,000 from the Product Stewardship Public Measures of Progress line item to support an editorial review of Product Stewardship code implementation guidance was approved. The Chemical Reporting Task Group is developing a follow-up strategy to the 8(e) comments and on addressing nomenclature issues. The Existing Chemical Testing Task Group is seeking a meeting with EPA and ITC staff to clarify testing protocols from the latest ITC report. The TUR Task Group is halfway through the development of a major communications study. Results from the study should be available in January or February, 1994. The group Citizens Action released a report that contains numerous inaccuracies regarding emission release volumes and equates Toxics Use Reduction to Pollution Prevention. The TUR Task Group will be asked to develop comments on the report. 10. B. Uenhart provided an overview of the Chlorine Chemistry Council (CCC). The CCC will lead industry advocacy and address health and safely issues for chlorine compounds. Future interaction between CCC and HSC on the application of generic product and risk policies is anticipated. A. Mason will be copied on future HSC meeting materials and will provide continuing updates on CCC activities. 11. D. Doyle provided an update on the activities of the Canadian Responsible Care performance verification program. The Canadian program combines all of the management practices into 17 categories that are subject to audits. The audit teams are composed of three individuals, two technical experts and a community representative. The audit program is still in the pilot stage and is expected to be approved in January. CMA will be monitoring the progress of the Canadian program as a potential pilot for a U.S. verification program. < CMA 061191 Health and Safety Committee November 17, 1993, Minutes Page 5 12.
