This Request is being made pursuant to the authority set fmth in Section 3007 of the Resource Conservation and Recovery Act ("RCRA"), 42 U.S.C. 6927. Pursuant to this authority, the Environmental Protection Agency, Region 6 ("EPA") may require persons with information relevant to the generation, storage, treatment, transportation, disposal, or otherwise handling of hazardous wastes to submit information to EPA to determine compliance with RCRA, 42 U.S.C. 6921- 6992k. PSC must respond to this Request within fourteen (14) calendar days of receipt of this letter. Compliance with this Request is mandatory. Failure to respond fully and truthfully to the Request or to adequately justify such failure to respond can result in enforcement action by EPA pursuant to Section 3008 ofRCRA, 42 U.S.C. 6928. The EPA is also evaluating the compliance of PSC with the PCB regulations found at 40 C.F.R. Patt 761. Under the provisions of Section 11(c) ofthe Toxic Substances Control Act ("TSCA"), 15 U.S.C. 2610(c), EPA has the authority to require the attendance and testimony of witnesses, the production of reports, papers, documents, answers to questions, and any other information deemed necessary by the Administrator in canying out the provisions ofTSCA. Accordingly, PSC must provide the information and documents set fmth in the enclosed SUBPOENA DUCES TECUM based on all information and documents in your possession, your custody or control, or the possession, custody, or control of your employees, agents, servants, or attorneys.
