The case had settled against Kaiser Shipyard; and, since there was no Petition for Contribution filed against SherwinWilliams, we double-checked with the Board, and learned that this matter is in fact off calendar. We do not think it will remain off calendar for very long, since we are anticipating receipt of a Petition for Contribution from Kaiser Shipyard, which will then allow them to begin the discovery process. There have been a number of motions and pleadings on the discovery issue which have remained in an off-calendar status pending results of the settlement. We will place our file on 60-day diary for purposes of determining if in fact co-defendant is pursuing the contribution.
