Section I - INTRODUCTION
CapturePoint, LLC/South Burbank Unit R Battery Inspection Date 03/18/2023
PURPOSE OF THE INSPECTION
EPA Region 6 inspector Matthew Allen arrived at the CapturePoint, LLC / South Burbank Unit (SBU) R Battery (EPA ID No. OKU002200) at 1:15 PM on 3/18/2024 for an announced inspection. This was an EPA inspection in response to a National Response Center Spill Report (NRC No. 1394063) which was received by EPA Region 6. The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. There was no other federal, state, or local agency representatives present at the time of the inspection.
FACILITY DESCRIPTION
EPA conducted an inspection at the CapturePoint, LLC South Burbank Unit, R Battery, where an equipment failure resulted in the release of a company estimated 200 barrels of saltwater. The released fluids migrated east along a drainage feature approximately 350 feet before spilling into an unnamed tributary of Little Chief Creek. Spill impacts migrated north along the tributary, eventually entering Little Chief Creek.
Section II - OBSERVATIONS
I observed the release point of the spill (see Appendix 1, Photo Log) Photo No. 1, which was a saltwater pumping station, where a saltwater flowline failed, releasing a company estimated 200 barrels of saltwater to the land surface. At the time of the inspection, the failed equipment had been replaced and the facility was operating as normal. For GPS location information and additional meta data, please see the photo log.
I observed the ovderland flowpath which migrated east from the facility along a drainage feature approximately 650 feet. The flowpath varied between 1 and 3 feet wide. The flowpath travelled across a significant downslope. See photo No. 2.
I observed the Point of Entry (POE) into an unnamed tributary of Little Chief Creek. At the POE, I observed an elevated TDS field reading of 46,964 mg/L. This was the highest TDS level observed throughout the inspection. The POE and associated TDS readings can be seen in Photos No. 3 and 4.
Continuing along the impacted tributary, I observed an elevated TDS field reading of 6,093 mg/L. This observation was made at the approximate midpoint of the flowpath along the tributary. This observation can be seen in Photo No. 5.
During the inspection, I observed men with equipment (including pumps and vacuum trucks) performing cleanup activities. See photos No. 6 and 7.

I observed a temporary containment dam which had been placed by the operator as part of the ongoing cleanup effort. The dam was placed to prevent further downstream migration of impacted waters. See photo No. 8.
I observed the POE into Little Chief Creek. At the same location, I observed an elevated TDS field reading of 29,576 mg/L (Photo No. 9). This was the highest TDS level observed in Little Chief Creek throughout the inspection. I also observed the streams physical characteristics at the same location. These observations are documented in Photos No. 10, 11 and 12.
Approximately 350 feet downstream from the POE, in the main channel of Little Chief Creek I observed the furthest downstream spill impact. This was in the form of an elevated TDS field reading of 7,910 mg/L, which can be seen in Photo No. 13. At this same location I observed the physical stream characteristics (bed and bank features) which can be seen in the downstream and upstream photos pictured in Photos No. 14 and 15.
Continuing downstream I observed a TDS field reading of 288.3 mg/L. This indicated spill impacts had not travelled to this point downstream. This photo as well as GPS location and other metadata can be seen in Photo No. 16. At the same location I observed many turtles and fishes which were seemingly unaffected by the spill. Photos No. 17 and 18 provide a downstream and upstream view from the observation location. I did not observe any impacted fish or wildlife at any point during the inspection.
I observed the lowermost temporary containment dam, upstream and downstream views, and a TDS field reading of 258.4 mg/L. This was the furthest downstream point observed during the inspection. See Photos No. 19, 20, 21 and 22.
Approximately .3 miles upstream from the POE into Little Chief Creek, I observed a TDS field reading of 319.8 mg/L in the main channel of the creek which was not impacted by the spill. This observation should be used when considering the "background" TDS levels in the area. See Photo No. 23.
Section III - AREAS OF CONCERN
The primary areas of concern included the overland flowpath impacted by brine, the impacted unnamed tributary, and the elevated TDS observations along Little Chief Creek.
Section IV - FOLLOW UP
Inspector will follow up via phone calls and site visits as needed until the impacted area is restored to "pre-spill" condition.
