Dear Mr. Atkinson: On September 27, 2023, representatives of the United States Environmental Protection Agency (EPA) completed a RCRA compliance evaluation inspection (CEI) of Parker Hannifin Corporation, EPA ID # MED093624526. The purpose of this inspection was to determine Parker Hannifin's compliance with the State of Maine Hazardous Waste Management Rules, Chapter 850-860 and the federal Hazardous Waste Management Regulations found at 40 CFR Parts 260-273. The State of Maine has been granted final authorization by EPA to administer certain portions of RCRA. As a result of the inspection noted above, EPA has determined that your facility violated certain provisions of the State of Maine Hazardous Waste Management Rules, Chapter 850-860 and the corresponding federal Hazardous Waste Management Regulations found at 40 CFR Parts 260 through 272. The violations are set forth below: 1. Failure to ensure that personnel successfully complete a program of instruction that teaches them to perform their duties and respond effectively to emergencies by implementing the facility's emergency procedures according to the facility's contingency plan that meets the requirements of 851(8)(B)(5) which incorporates by reference 40 CFR 246.16. Hazardous waste training for Mr. Cary Atkinson who is the plant manager and emergency contact listed in the contingency plan has not been completed since 2022. Mr. Todd Leland, who was the previous plant manager and emergency contact before Mr. Atkinson, was last trained by Triumvirate Environmental in 2018. 2 Other employees that handle hazardous waste on site were trained by the facility in 2023 per documents reviewed on site and an email received from the facility on 2/26/2024. Parker Hannifin must address the requirements set forth above and must immediately begin and continue to operate in compliance with all applicable Federal and State regulations. Within (30) thirty calendar days of receipt of this NOTICE, submit a written description, with supporting documentation, of the actions taken to address requirements above.
