MINUTES Committee: Place: Date: Public Affairs Palm Springs, California April 12,1981 The AACPP Public Affairs Committee met on Sunday, April 12, 1981 at 1:15 p.m., at the Canyon Hotel Racquet & Golf Resort, Palm Springs, the Chairman being in the chair and the Secretary being present. Call to Order The Chairman declared a quorum present and called the meeting to order, n. Reading and Approval of Minutes A motion was made and passed " ... that the reading of the February 25, 1981 minutes be dispensed with and approved as distributed." ID. Review of Agenda The meeting agenda was reviewed and the order of business modified as follows. IV. Report of Officers A. Chairman's Report Chairman Olson expressed the view that the time has come for the A/C pipe industry to make more effective use of the fact that after millions of dollars of government and independent research, there still exists no evidence of a cause and effect relationship between the use of A/C. pipe and any disease. He stated that this important milestone for the industry should guide Committee activities in the coming years. B. Staff Report Staff reviewed personnel changes within the Association. Quarterly status sheets for PAC and TAC programs were distributed. -1CAPCO JEN OOI0418 h V. Priority List A. PAC-01-80, Regulatory Affairs Program Staff reported that the draft of the economic impact assessment of a ban on A/C pipe in the United States had been edited and would be transmitted to the contractor, Arthur D. Little, Inc. A motion was made and passed " ... that the PAC has no objections that the Board take whatever action necessary to transmit the economic impact assessment to Kirkland & Ellis for support in regulatory negotiations with EPA." Mr. Dougherty reviewed progress of negotiations with EPA. Mr. Dougherty and Mr. Reis also reported on an industry meeting with the Assistant Secretary for Occupational Safety and Health. A letter from Kirkland & Ellis to the Assistant.Secretary was distributed. A list of information needs outlined by Kirkland & Ellis were discussed. The Committee agreed without motion that AACPP should be responsive to these information needs within the AIA/NA framework and the time schedule dictated by Kirkland & Ellis. A motion was made and passed "that the AACPP energy report be released to PAC for review with an eye towards updating and publishing it as an Association publication." B. PAC-02-80, Public Education Program 1. Fact Book/Tip-Ons Staff distributed three "tips-ons" prepared for (1) elected officials, (2) water utility managers and (3) public health officials. Member companies were asked to advise Staff of needs for tip-ons by April 27, 1981. Staff reported that Lewis & Gilman was preparing for Staff review and approval a number of lists for direct mailing of the "A/C Pipe and Drinking Water" booklet and tip-ons to legislative and public health offical target audiences in core market areas. Atlas-Turner requested that similar mailings be considered for Canada. 2. Press Kit The completed press kit was distributed to the Committee. Staff reported that over 1,100 kits had been distributed to daily newspapers in the United States and Canada, as well as to 100 medical publications. 3. Seminars Staff reported that "A/C Pipe and Drinking Water" presentations would be made at the following American Water Works Association meetings: New England Section, Texas Section, National Conference, as well as the Conference of State Sanitary Engineers and the Pennsylvania Water Works Operators. Other program dates are pending. Mr. van der Rest emphasized the value of having independent scientists give presentations on the safety of A/C pipe, rather than industry representatives. -2- CAPCO JEN 0010419 \ 4. Audio Visual Programs It was reported that revision to the "A/C Pipe and Drinking Water" and "Recommended Work Practices for A/C Pipe" A/V programs will coincide with third quarter revisions to the companion booklet. 5. Advertising a. Product Promotion Ad A reprint of the "Durable" product ad was distributed for Committee review. While the Committee liked the ad, concerns were expressed about the saw mark on the front edge of the pipe photo. A motion was made and passed " ... that the ad be pulled from those publications where it was still possible to do so, and appropriate revisions be made to the pipe photo." Lewis & Gilman distributed the product promotion ad media schedule for 1981 and 1982. There was no discussion. b. Advocacy Ad Staff reported that revisions to copy for the advocacy ad will be completed, and the ad produced by the end of May, 1981. c. Product Safety Ad and Pretest Methodology The proposed study to pretest product safety ads for A/C pipe was reviewed by Lewis & Gilman. The agency recommended that if the Committee concluded that it was necessary to run a safety ad, at a minimum it should pretest the ad prior to placement. It was the opinion of Lewis & Gilman that information regarding the safety of A/C pipe could be better directed to legislative and public official target audiences through vehicles other than space advertising. A motion was made and passed, Johns-Manville dissenting, " ... that the Committee accept the recommendation of Lewis <5c Gilman." 6. Health Fact Sheets A detailed layout for a series of health fact bulletins ("A/C Advisory") .was presented and approved without vote. Proposed copy for the first advisory (NIEHS Feeding Study) was distributed for review and approval. It was agreed that the Committee would submit comments on the first Advisory and define corporate needs by April 27, 1981. 7. Trade Press Releases Lewis oc Gilman reported that in March the first trade press release (results of NIEHS studies) were sent to trade media (list distributed). Three additional releases (EPA Region 6 letter, industry position on water quality criteria for asbestos, and Dr. Higgins letter to the Journal of Epidemiology re Kanarek study) will be made in April and May, 1981. Staff distributed an industry response to the Millette article in Water Engineering and Management magazine. Members were asked to define needs for reprints by April 27, 1981. 8. Utility Initiative A detailed layout of a bill stuffer for use by water utilities with field problems was reviewed and approved without vote. -3- CAPCO JEN 0010420 9. State of the Art Medical Paper Mr. Dougherty reported on the April 2-3 meeting of medical experts on asbestos. It was reported that a preliminary report is expected on or about April 21,1981. 10. Crisis Management Team Staff reported that it had completed media training. Revision of field problem protocol to reflect addition of Lewis & Gilman staff still in progress. 11. Recommended Work Practices - Phase III Staff reported that no action was planned until the third quarter. C. PAC-04-80, State Monitoring Program 1. Connecticut Staff reported that the Commissioner of Health Services is expected to hand down his decision on the industry's petition about June 2,1981. 2. Massachusetts Staff reported that if H. B. 2349 passes it will be necessary for the industry to nominate an individual to the task force that will study the health hazards of vinyl-lined and conventional A/C pipe. In that regard, the Committee was asked to submit nominations to Staff by April 27, 1981. No change in status in litigation between Attorney General and JohnsManville re vinyl-lined A/C pipe. 3. New Jersey Staff reported that it had been advised by legislative counsel that plans to introduce legislation to ban A/C pipe in New Jersey had been withdrawn. It also was reported that the Department of Environmental Protection does not plan to propose use/acceptance regulations for the product. Mr. Dougherty distributed a news clipping regarding problems in Brick Township (Ocean County). 4. Wisconsin Staff reported that the trial date in Crivitz is now unclear; AACPP counsel will follow the status of the ease. Staff reported that according to EPA reports, 6500 feet of corroded A/C pipe was being removed in Black River Falls Mission, (Indian Health Service project). Due to the large number of field problems in the State, Staff was directed by the Committee to conduct a fact finding mission at the earliest opportunity. 5. A proposed program sheet for PAC-04-80 (State Monitoring Program) was distributed for Committee review and comment by April 27, 1981. VI. Old Business A. AWWA Ad Hoc Committee on Asbestos in Drinking Water Staff distributed industry revisions to Draft $2 of the Ad Hoc Committee's position statement on asbestos in drinking water. -4- CAPCO JEN 0010421 VH. New Business A. PAC Meeting Frequency A motion was made and passed " ... that the PAC meet on a quarterly basis." B. Letter to EPA Health Effects Research Laboratory (HERL) A draft letter to EPA/HERL was distributed for review and comment. The Committee agreed with the basic approach of the letter and directed Staff and counsel to prepare as strong as letter as possible for the Director, HERL. VUI.
