Kehoe Kettering Laboratory of Applied Physiology College of Medicine Cincinnati, Ohio Dear Dr. Kehoe: Today we received a copy of your letter of May 6th to Mr. 0. B. Lewis relative to the "alleged lead poisoning" of a former employee of the Phillips Petroleum Company refinery in Kansas City, Kansas. This letter has caused us some concern inasmuch as it indicates that we have been negligent in our duty to report all such cases to you. This case which involves an ex-employee named Everett 0. Dowell was first reported to us by Mr. H. H. Booth, Phillips' attorney, on December 4> 1945. A complete report of our interview with Mr. Booth was forwarded to you with a covering letter on December 7, 1945 with copies sent to Messrs. 0. B. Lewis and J. E. Boudreau. As this letter was not acknowledged and may not have reached you, we are attaching copies so that your file will be complete. As stated in our report, Mr. Booth indicated that if any further information was required in connection with this case, he would communicate directly with you. Mr. Nixon's incidental interview with Mr. Booth at the refinery, as reported in his weekly letter of April 2nd, developed no new information and was therefore not reported separately. The omission of any information which might have been con sidered pertinent'is therefore my own responsibility and not Mr. Nixon's. However, Mr. Booth indicated that the case would never come to trial, and was related to tetraethyl lead only indirectly, as Mr. Dowell's claim of respiratory trouble was all inclusive mentioning gasoline and fuel oil vapors, sewer gases, etc. Mr. Dowell was an electrician who had no opportunity to be exposed to TEL. Mr. Booth informed me today that the case was settled out of court and Phillips' Petroleum Company has obtained a release for $250.
