Plaintiff filed in the court below a notice of motion for judgaant, seeking to
recover damages for the wrongful death of plaintiff* s deeedont. She alleged
that the defendant owed its employees the duty of furnishing thsm a reasonably
safe place in which to work, and to that end should have installed in the mine
where deeedont worked the necessary devices to ventilate it properly.
The
defendant filed a demurrer to the notice of motion for jud^ent alloging that
by virtue of the provisions of the Vortaaon** Compensation Act ths lowwr court
was deprived of jurisdiction of the subject-matter of the suit. To a judgaeat^
sustaining a demurrer plaintiff obtained this writ of error. The plaintif- s

survey of the earlier litorature emphasizes the difference between "aliclncsls"
and silicosis. The former is characterized by the symptoms of bronchial catarrh,
inflammatory cell proliferation, and x-ray evidence of diffuse fine stippling,
but no fibrosis, as demonstrated by Joetten and by Shri.taann in 1939 in animal
experiments in an ateiosphere containing 50*100 og* of aluslnui bronze dust per

worker poisoned by manipulating material soaked with methanol in a centrifuge.
The material contained 30-40)1 of methanol, but no complaints had been made evar
a period of 6 years until blackout measures were instituted. In this case,
symptoms were pleural irritation and serious failure of vision, particularly
the right eye. After 6 weeks moral from exposure the vision improved so that
fine print could be read at a distance of 20 cm* The pleural irritation, which
was considered due to enlargmaont of the liver returned after 14 days return to
wzfc. The only other pathological signs were a decreased patellar reflex and

effects of fixed-pace work of the conveyor-belt type upon hvman efficiency \nd
health. The investigation was based upon a study of production and illness
records of 1033 employees in three plants. The isveetlgatlon disclosed that
fixed-pace work is detrimental to health and contributes to ierk dissatisfaction
and strained relationships between employer and worker, The investigator sug
gests: (1) more careful choice of suitable employees for fixed-pace work; (2)
regular rest periods in order to decrease fatigue, break monotony and inspect
machinery, and (3) variation of machine speeds in accordance with human fatigue
curves.

516 The OWI announces that more than 97 per cent of Naval and Marino rounded, from Pearl Harbor to March 31, 1943, have recovered. Those figures were contained in a report by OWI on the cere of the rounded by the medical deparkaents of the Army and Navy. Percentage figuroe for the recovery of Army rounded aro not available at proeent owing to incompleteness of records from ths fighting fronts. An analysis of available data on Army rounded shows that recoveries are compar able to Naval and Marine percentages. Of all Navy and Marine personnel rounded only 2.6 per cent died subsequently. Fifty-three per cent were returned to duty. Still under treatment as of March 31 were 43*3 per cent. Invalided from service were 0.9 per cent.
