Warm Springs, OR 97761 RE: Failure to Submit 2022 Consumer Confidence Reports (CCR) for Sidwalter, PWS ID # 104101101, Simnasho Schoolie, PWS ID # 104101102, and Warm Springs Water Treatment Plant, PWS ID # 104101247 Dear Mr. Palmer: Warm Springs failed to provide the 2022 Consumer Confidence Reports (CCR) to its customers and EPA by July 1st, 2023. This constitutes a violation under the National Primary Drinking Water Regulations. Warm Springs submitted copies of the 2022 CCRs to the EPA on July 12th, 2023, and these violations have now been returned to compliance. Thank you for promptly addressing these violations. No further action is needed at this time. In accordance with 40 CFR Subpart O, Community water systems must provide an annual water quality report to all customers served, disclosing information about the drinking water source, contaminants detected and their health effects, violations and significant deficiencies. The report covers one calendar year and must be distributed to customers by July 1st of the following year. This letter serves as initial notification of non-compliance under the Safe Drinking Water Act for the regulation and time period cited. EPA supports compliance assistance and encourages early action to return to compliance. Issues not addressed in a timely manner may be referred to enforcement. Prior to an enforcement action for the cited violation(s), EPA Region 10 will offer government-to-government consultation, in accordance with the EPA Policy on Consultation and Coordination with Indian Tribes.
