The fuel at this Facility is sold to the public. The Environmental Protection Agency's Facility records indicate that the Facility has three (3) 12,000-gallon, STI-P3 constructed underground storage tanks (UST) that were installed in 1999. Tank 1 stores regular unleaded fuel, Tank 2 stores premium unleaded fuel, and Tank 3 stores diesel. Piping for all tanks is pressurized and constructed of flexible plastic. Piping was upgraded in July 2024 after adverse weather damaged the Facility. Inspection Narrative On June 10, 2025, the EPA UST program personnel conducted an inspection at Spirit Lake Marina in St. Michael, North Dakota. The EPA last inspected the Facility on May 17, 2023, and it was selected for routine re-inspection. The EPA inspector spoke with the Facility representative and sent a follow-up letter on May 14, 2025, to schedule the inspection and provide inspection details (see Attachment A). The inspector arrived at the Facility at 2:15 p.m. CDT and was met by the Facility representative, as well as from the Spirit Lake Tribe's environmental office. The EPA inspector introduced herself and presented inspector credentials. The Facility representative consented to the inspection. The EPA inspector conducted a physical inspection of the UST system as well as a review of Facility 3020012 Spirit Lake Marina Page 1 of 3 6/10/2025 UST Inspection records. Photographs of UST system components taken during the inspection are in Attachment D. Copies of operation and maintenance records are in Attachment B. Tank Leak Detection Tank leak detection equipment consists of an automatic tank gauge (ATG), which conducts continuous statistical leak detection (CSLD) tests. The Facility representative had printed test records for each of the tanks through April 2024. In April of 2024, the system was placed in temporary closure during the line upgrades. A new ATG console and probes were installed and became operational in July 2024. The regulatory report printouts from the new ATG, a Franklin ECO600, do not include the testing results for the tanks. The EPA inspector was able to print a 90-day history from the console, but the system would not provide any additional months. The operator contacted the ATG service provider, who will work with them to ensure records are being generated for the tank release detection system. The system was less than one year old at the time of the inspection, therefore no additional functionality testing records were available. Piping Leak Detection A piping upgrade was performed in July 2024 following a weather-related incident at the Facility. Piping leak detection is satisfied by electronic line leak detectors (ELLD) and interstitial monitoring of the double walled piping. Sensors, sumps and lines were all documented as replaced during the July 2024 system upgrades. Records of the monthly sensor status since July 2024 were available at the time of inspection. Cathodic Protection The Facility's UST system is constructed of STI-P3 tanks, which have sacrificial anodes. The last test record provided by the facility was dated October 12, 2020. The operator stated that a test had likely been performed in September 2023, but the record could not be located. The operator has already contacted a service provider to conduct the testing, but it has not yet been scheduled. Periodic Testing/Inspection of Spill and Overfill Prevention Equipment New spill buckets and overfill prevention equipment (flapper valves) were installed as part of the July 2024 system upgrade. Valley Petroleum confirmed this in a follow-up email sent on June 17, 2025. Documentation of the upgrade was sent to the Facility's insurance provider, but not the operator. The operator will be sent records by the contractor to maintain for the life of the system. Periodic Operation & Maintenance (O&M) Walkthrough Inspections Records of monthly and annual walkthrough inspections for the last twelve months were provided at the time of inspection. Operator Training A certificate for Class A and B operator training was maintained onsite at the time of inspection as well as Class C training documentation. 3020012 Spirit Lake Marina Page 2 of 3 6/10/2025 UST Inspection Financial Responsibility The Facility uses private insurance to satisfy the requirements for financial responsibility coverage. Documentation of the coverage was available at the time of inspection. Physical Observations The EPA inspector viewed the spill buckets/fill pipes, selected dispensers, tank top sumps, and the ATG console. Flapper valves were observed in each fill pipe and spill buckets were clean and dry. As of July 2024, the spill buckets are now remote fill and located at the street level, near the tank vents. The tank top sumps were in good condition and had sensors positioned for line monitoring. The dispenser for the marina could not be opened at the time of the inspection as the keys provided did not work. The fueling station under-dispenser sumps were contained and had sensors properly positioned for line monitoring. Inspection Conclusions and Recommendations At the end of the inspection, Ms. Person filled out an Onsite Deficiency Identification Form (see Attachment C). Prior to departing the Facility, Ms. Person stated that a full inspection report would be forthcoming, which includes the inspection checklist (see Attachment D). Ms. Person provided the Facility representative with the deficiency form and retained carbon copies of each form for recordkeeping. Inspection Report Attachments A.
