These 20 amended responses are based upon additional information obtained 21 by Rockbestos since the date it filed responses. All prior 22 responses to General Order No. 29 Standard Interrogatories are 23 hereby withdrawn. 24 /// 25 /// 26 /// 27 /// 28 tt 1 X. PRELIMINARY STATEMENT AND GENERAL OBJECTIONS 2 3 Rockbestos, is a Delaware Corporation with its 4 principal place of business in Connecticut. The information 5 contained in these responses has been assembled by authorized 6 employees and counsel for Rockbestos. It is impossible to 7 reconstruct each step in the information gathering process or to 8 state that all pertinent documents have been discovered and 9 examined. It is also impossible to state that all individuals 10 with relevant knowledge have been contacted as of this date. 11 Investigation continues and Rockbestos specifically reserves the 12 right to revise, correct, supplement and amend these 13 interrogatory responses. Moreover, Rockbestos objects to the 14 interrogatories on the grounds that they seek "corporate 15 knowledge" because it is impossible for Rockbestos to set forth a 16 collective knowledge of all Rockbestos employees, past and 17 present. _ 18 19 Rockbestos has never mined asbestos fiber or 20 manufactured asbestos thermal insulation. Many of the 21 interrogatories request information relating to the mining of 22 asbestos and the processes utilized in manufacturing raw 23 asbestos. Rockbestos objects to these and other interrogatories, 24 propounded as a boilerplate set of interrogatories in that they 25 are not designed to elicit discoverable information from 26 Rockbestos. 27 /// 28 2 I *< 1 Many of the interrogatories exceed the permissible 2 scope of discovery as defined by California Code of Civil 3 Procedure 52017, by requesting information which is neither 4 relevant to the subject matter of this action nor reasonably 5 calculated to lead to the discovery of admissible evidence. The 6 interrogatories are also overbroad as to time, scope, and 7 geographic boundaries because they seek information relating to 8 products manufactured between 1930-1985, a 55 year period, and 9 are not limited to products allegedly used by 10 plaintiff/plaintiff's decedent or allegedly sold and/or supplied 11 to plaintiff's/plaintiff's decedent's employers during the period 12 of plaintiff's/plaintiff's decedent's employment. Accordingly, 13 the interrogatories are objected to on these grounds and on the 14 further ground that the information sought by many of the inter 15 rogatories is so burdensome to ascertain as to be unjust, harass 16 ing, annoying and oppressive.* 17 *- 18 Rockbestos further objects to the interrogatories to 19 the extent that they assume the truth of matters specifically 20 denied by Rockbestos or which have not been established by 21 plaintiff. In addition, Rockbestos objects to the 22 interrogatories to the extent that they seek privileged 23 information, proprietary information, confidential trade 24 information, marketing information, chemical compositions and 25 other information entitled to protection under California Code of 26 Civil Procedure 52017 and 2030, and/or which is otherwise subject 27 to the attorney-client privilege or the attorney work product 28 3 ft 1 doctrine as provided by California Code of Civil Procedure 2 2018. 3 4 Rockbestos was not a party to any action in San 5 Francisco Superior Court on June 21, 1985 when General Order No. 6 29 was issued and did not receive notice of the application for 7 consolidated discovery. Moreover, Rockbestos did not appear at 8 the hearing on the notion for the order consolidating discovery 9 and has had no opportunity to be heard with regard to that order 10 or to the form of discovery propounded. In addition, the Civil Discovery Act of 1986, California Code of Civil Procedure 2016 11 et sec.. which became effective on July 1, 1987, has superseded 12 13 General order No. 29. Thus, the Court is without jurisdiction to 14 modify the discovery procedures established by the state legisla 15 ture and codified in California Code of Civil Procedure 2030, 16 and absent a legislative enactment, the legislature's governing 17 provisions pertaining to interrogatories cannot be overruled by a 18 local court rule. Shadle v. City of Corona. 96 Cal. App. 3d 19 173, 177 (1979). . 20 The interrogatories also violate the order*, amending 21 General order No. 43, of April 2, 1990 which declares that the l 22 provisions of California Code Of Civil Procedures 2024 through 23 2036 are applicable to all complex asbestos litigation without 24 exception. 25 26 /// 27 /// 28 4 <t 1 More specifically, the interrogatories and their 2 subparts exceed the Statutory number permitted by California Code of Civil Procedure 2030(c) and are not accompanied by a 3 4 declaration for additional discovery. Thus, the interrogatories 5 are objected to on these grounds and to the extent that many of 6 the interrogatories are not complete in and o'f themselves, 7 contain subparts, are compound, conjunctive or disjunctive in 8 violation of California Code of Civil Procedure 2030(c)(5). 9 Moreover, the interrogatories contain instructions and 10 11 definitions" which do not comply with California Code of Civil 11 Procedures 12030(c)(5), are overbroad, vague, inconsistent with 12 normal usage and meaning and are unintelligible. To the extent 9 possible, Rockbestos will attempt to provide this information for 10 products to which plaintiff/plaintiff's decedent alleges 11 exposure. Rockbestos' wire and cable products generally did not 12 have any external markings, although the boxes, spools or reels 13 containing the products generally were marked or tagged with the 14 names Cerro or Rockbestos, the brand or trade names Firezone, 15 Firewall, Rocktherm, Pyrotrol, Phosroc, Cryozone or H-Zone, an 16 hourglass within a circle or other distinctive markings. In 17 general, wire and cajble products were marked internally with 18 marker threads. . 19 20 (f) It would be unduly burdensome to provide a 21 detailed description of the intended use of each product. To the 22 extent possible, Rockbestos will attempt to provide this 23 information for products to which plaintiff/plaintiff' decedent 24 alleges exposure. The intended use of wire and cable products 25 with insulation containing encapsulated and saturated asbestos is 26 in those applications requiring resistance to high temperature 27 28 13 (( 1 and flame, and as required in military, government and trade 2 specifications for certain wire and cable construction; * 3 4 (g) Rockbestos is without sufficient information and 5 knowledge at this time to respond to this subpart.
