A- DeBernardi Date May 20, 1980 Subject Voluntary Disclosure of Handicap Conoco Inc. is a Government Contractor subject to Section 503 of the Rehabilita tion Act of 1973 which requires government contractors to take affirmative action to employ and advance in employment qualified handicapped individuals. As Manager of the VCM Plant, it is my responsibility to see that affirmative action is taken to comply with Section 503 of the Rehabilitation ACt. The definition of a handicapped individual included in the VCM Plant's Affirma tive Action Plan is as follows: A handicapped person is one who has a physical or mental impairment substantially limiting one or more of such person's major life activities, has a record of such an impairment, or is regarded as having such an impairment. A handicapped individual is substantially limited if he or she is likely to experience difficulty in securing, retaining or advancing in employment because of handicap. If a VCM Plant employee believes they are handicapped as defined above, and desires to be considered under the affirmative action program, they are re quested to make this desire known to me by voluntarily and personally informing the Office Manager at the VCM Plant. A copy of the attached form will be pro vided to the employee by the Office Manager for completion by the employee. Submission of this information and completion of the form is voluntary and refusal to provide the information requested will not subject any employee to discharge or any type of disciplinary action. Information obtained concerning an employee's handicap shall be kept strictly confidential, except that 1.) supervisors and managers may be informed regarding restrictions on the work or duties of handicapped individuals and regarding necessary accommodations, 2.) first aid and safety personnel may be informed, when and to the extent appropriate, if the condition might require emergency treatment, and 3.) govern ment officials investigating compliance with the act shall be informed. The information submitted addresses each item of the PSD information package outline obtained from your office. Additionally, our state permit was approved on March 25, 1980. Therefore, all state and local requirements have been met. In accordance with the existing 1978 PSD regulations (Title 40, Part 52, Section 52.21 (r) (1) which state that the Environmental Protection Agency will provide a first stage completeness review within 30 days of the permit application submission date and with the failure of the Environmental Protec tion Agency to provide such a review within the required timetable, Conoco Chemicals assumes that the existing 1978 PSD regulations will apply to the proposed modifications.
