MINUTES /'S The third meeting of the MCA Special Committee on Toxic Substances Legislation was held January 20, 1976 at MCA headquarters in Washington, D.C. Attendees were: R. E. Heckert, Chairman, Du Pont; W. J. Driver, MCA; Warren Easely, Monsanto for Sam Pickard; B. D. Forrow, Allied Chemical; J. II. Hanes, Dow; T. W. Hanavan, Du Pont; G. W. Ingle, MCA; J. J. Kenney, Jr., Union Carbide; Daniel Mayers, Wilmer, Cutler & Pickering; J. E. McKee, Jr., Monsanto; Victor Peterson, MCA (guest); and II.L.P. Wendell, Du Pont. Messrs. G. Dominguez, Ciba-Geigy; S. Pickard, Monsanto; R. L. Shafer, Pfizer; and W. M. Stover, MCA, were absent. The December 30, 1975 Minutes were approved without revision. Mr. Heckert then asked Mr. Kenney to report on pend ing legislation. Mr. Kenney reported there have been no sig nificant developments. The following reports were then given. Status Report Mr. Driver reported that a draft Lynn letter to Congressman Van Deerlin was being reviewed with Quarles and that there were still some reported differences of views between EPA and OMB. Mr. Heckert reported briefly on the January 8, 1976 Ryan, EPA meeting as to which each member of the Committee had already received a summary. He also reviev/ed the January 12, 1976 appearance of Dr. Zapp on behalf of MCA at the House Environmental Study Conference Panel on "Cancer and the Environ ment". The Committee agreed with Mr. Heckert's recommendation that it was essential to challenge and negate the environ mentalists' claim of a cancer epidemic due to chemicals by whatever competent analysis can be made from current published data. Du Pont experts have been asked to develop this position. The Committee agreed that a further effort should be made to contact Lynn for an immediate meeting before OMB1s views become final. Later in the meeting Mr. Driver received a message from OMB that a meeting with James L. Mitchell, Associate Director for National Resources, Energy and Science Office-of Management and Budget, was set for Monday, January 26, at 2 p.m. Messrs. Heckert, Driver, Kenney, Mayers and Hanavan will attend. Messrs. Hanavan, Ingle and Kenney were named to a special subcommittee to develop the approach on the key issues that will be discussed at this meeting. Mr. Ingle reported on the 1/15/76 toxic substances seminar sponsored by the House Environmental Study Conference. 000040960 dth r> 3 The subcommittee previously noted will make a final recom mendation at a preliminary meeting set at noon, January 22, 1976, at the offices of Wilmer, Cutler & Pickering. Legislative Development (J. J. Kenney, Jr.) "Grass Roots" Since reports are not expected until the end of January, Mr. Kenney had little to report other than his per sonal knowledge of his company's activities and the activities of several other companies. Mr. Kenney reported the dates of the forthcoming Congressional breakfast meetings as New Jersey Ohio New York California - 1/27 - 1/28 - 2/4 - 2/5 Mr. Heckert indicated he had agreed to speak in New Jersey and Ohio and to attend the California breakfast. Richard J. Hughes, Union Carbide, Vice President, will be the speaker at the New York breakfast. Mr. Heckert said there'is an essential need for broad participation and attendance at these breakfasts by CEOs and other senior corporate executives. Issue Statements (T. W. Hanavan) Mr. Hanavan presented for discussion a draft of a statement on gaps. It was recommended that it be revised with more emphasis on the scope of existing laws in other areas; and that industry has generally considered a wide range of environ mental factors as points of concern in product development. Seven position papers were presented for discussion. It was concluded that the format was unsatisfactory for mean ingful use. A subcommittee was formed (Messrs. Hanavan, Ingle, Easely, Dominguez and Wendell) to revise the position papers starting with an affirmative statement of views followed by a more detailed listing of areas of specific concern about each issue. Mr. Kenney pointed out there was another issue of con cern not heretofore considered involving possible duplicative testing. It was agreed to develop amendment wording. DTH 000040962
