The effective date of this rule was August 30, 1982 and applies to United States asbestos manufacturers, processors and importers. The EPA requires individual plant sites to report quantities of asbestos used in manufacturing a product, processing bulk asbestos and asbestos mixtures, and the importation of bulk, mixtures, and articles containing asbestos. EPA designated two groups for reporting purposes: the Primary Processor and the Secondary Processor. The Primary Processors are persons engaged in mining, milling and importing bulk asbestos, or who process bulk asbestos to form an asbestos mixture or product such as asbestos paper. The primary processor must report on EPA Form 7710-36 "Reporting Commercial and Industrial Uses of Asbestos" within 90 days of the effective date. The Secondary Processors are persons who import asbestos mixtures or who start with asbestos mixtures and incorporate it into a product. An example of a secondary processor would be cutting asbestos cement sheets into gaskets for incorporating into a valve or pump. The secondary processor must report on EPA Form 7710-37 "Reporting Secondary Processing and Importation of Asbestos Mixtures" within 60 days of the effective date. The EPA will then select a sample of respondents from the secondary processors to complete the Primary Form 7710-36. 03114297 r HUBB-0032418 Both EPA Forms 7710-36 and 7710-37 and instructions on completing the form are attached. Each respondent is to complete the relevant sections of the form depending on activities of the plant. Some primary processors are also secondary processors and will have to complete both sections of the Primary Form. Be sure to use the correct codes from the Instruction Section when completing either form. Several Westinghouse products which contain asbestos are listed in the attached table. a-i Exemption from Reporting: , The EPA has exempted certain classes of potential respondents from 3 the requirements of the rule. The exempt class include: v-_r 1. Companies employing 10 or fewer employes. 2. Secondary Processors who apply, assemble, install, erect or consume asbestos products without modifying or fabricating the asbestos product. Example--an appliance manufacturer who installs electric motors containing asbestos components would be exempted. 3. Persons who repair articles, repackage asbestos mixtures without modification or who engage in construction work. 4. Persons who are distributors and do not manufacture, process or import bulk asbestos or asbestos products. 5. Persons who are "end users'1 of bulk asbestos or asbestos products and do not further distribute such items in commerce. Example--asbestos welding blanket. Plant's Responsibility: Each plant must survey their facility and determine whether the EPA Asbestos Reporting Requirements apply. If the EPA Asbestos Reporting Requirements apply to your plant, then a decision must be made as to which form applies. Then complete either EPA Form 7710-36 or 7710-37 and send completed form to Headquarters Environmental Affairs by October 11, 1982. The EPA 7710-36 asks for detailed data on products, importation, worker exposures, waste and disposal and pollution control equipment. Therefore, allow sufficient time to gather this data and complete this form. If the EPA Asbestos Reporting Requirement does not apply, then sign the attached Negative Declaration and return to Headquarters Environmental Affairs. Headquarters Environmental Affairs Responsibility: Headquarters Environmental Affairs will coordinate the corporate-wide response on importation of asbestos and will review the individual completed responses. Introduction These instructions are for companies that mine and/or miff commercial asbestos, or process or import an asbestos product, and are required to submit EPA Form 7710-36 under 40 CFR Part 763. Subpart D. Data must be reported to the extent that they are known to or reasonably ascertainable by the submitter based on factual information that either is available in company files, or ean be obtained without unreasonable burden or cost. Importers must report information in their possession, buj need not contact foreign manufacturers for missing information. 1. Fill in all blocks. Fill in all blocks in the portions of theform that must be completed. Wnie "N/A" (not applicable) m large, bold letters on the first line of any section that does not have to be completed. If data for a portion of the form that must be completed are not available, consult part 11 of these instructions. "Missing Information." EPA will check all forma for completeness. Incomplete forms may be returned for completion. If only a few items are Incomplete. EPA may call the designated Technical Contact to determine the correct answer rather than return the form. 2. Relevant Definitions. Reporting requirements are determined by the company's asbestos activity in 1981 (i.e_ miner and/or miller, importer of bulk asbestos, primary processor of asbestos, secondary processor of asbestos, importer of asbestos mixtures, or importer of articles containing asbestos components). Definitions for reporting activities snd other terms used in this form may be found in Appendix A. 3. Appropriate Number of Forms. A separate form must be submitted for each site. For example, a miner and/or miller at one site who is a primary processor at a different site mult submit a form for aach cite. All asbestos activities conducted at each site must be reported. A primary processor who also imports asbestos at a single site must report both the primary processing and Importing activities on the same form. 4. Additional Space. If additional space is needed to report all required information, responses can be entered on a reproduction of the pertinent portion of the form and the continuation should be noted on that part of the form. & Portions of the Form To Complete and Reporting Schedule 1.
