Box 1196 Warm Springs, OR 97761 Re: Violation for Failure to Monitor and Report TTHM/HAA5 Warm Springs Water Treatment Plant, PWS ID 104101247 Dear Mr. Palmer: The EPA did not receive sample results for total trihalomethanes (TTHM) and five haloacetic acids (HAA5) for the first quarter of 2023 (1/1/2023 - 3/31/2023) as required under the Stage 2 Disinfection Byproducts Rule (DBPR), according to 40 CFR 141.621-623. As a result, Warm Springs Water Treatment Plant water system is in violation of the National Primary Drinking Water Standards. Warm Springs Water Treatment Plant water system is currently scheduled to take one (1) sample every year at the Kah-Nee-Tah Village Main Shop (Sample Site WS-10) between 2/1 and 2/28 and one (1) sample every year at 9021 Tenino Road (Sample Site WS-10) between 5/1 and 5/31. Results must be reported to the EPA by the 10th of the month following the sampling period. To return to compliance you must either: 1. Submit TTHM and HAA5 sample results from WS-10 collected 2/1/2023 - 2/28/2023. -OR1. Collect TTHM and HAA5 samples at the required sample sites and submit results to the EPA. 2. Notify customers of this violation within one year in your Consumer Confidence Report (CCR). Since your Public Water System is currently on a reduced monitoring schedule, you will be put back on the standard monitoring frequency which involves collecting TTHM and HAA5 samples from the sites noted above on a quarterly basis. You may be eligible to resume a reduced monitoring schedule when the violation is returned compliance after completing the missed monitoring requirement. This letter serves as initial notification of non-compliance under the Safe Drinking Water Act for the regulation and time period cited. EPA supports compliance assistance and encourages early action to return to compliance. Issues not addressed in a timely manner may be referred to enforcement. Prior to an enforcement action for the cited violation(s), EPA Region 10 will offer government-to-government consultation, in accordance with the EPA Policy on Consultation and Coordination with Indian Tribes.
