Borden and Formosa representatives will check on the status of payment within their companies. George Marshall reported that MAXROY will not join the Committee as an Associate Member this year. Has Shah will prepare a "white paper" on the Vinyl Chloride Transportation Committee for review by Mr. Marshall and Vergel Perry. The paper will describe the goals and objectives of the Committee and activities and accomplishments to date. The white paper will be used for receiving additional support from company management for Committee activities and for membership solicitation. CMA 111820 Vinyl Chloride Transportation June 6,1995 Page 2 3.0 The Committee reviewed the final VCNet map. Copies will be sent to Committee members by regular mail in the next few weeks. Future changes to the map include: 1) designation of Georgia Gulf's response teams; 2) revisions to the designations in the key (i.e. remove the "T" designation for industry; add "Railroad T" for transfer capabilities); and, removal of GEICO in Ohio. Committee members will review the small maps and send any comments to Dr. Shah for future revisions. Ludi Benner will update the railroad information on the map. 4.0 The Committee reviewed the VCNet Operation Manual table of contents to determine whether information should be removed or added. The following action items were discussed; Dr. Shah will distribute the 24 hour phone and fax numbers for review and updating; MAXROY, Certainteed, and Vygen will be removed from and Bayer will be added to the Non-Member Shipper Company List; Mr. Benner will update the railroad emergency response information including CSX and KCS; Dr. Shah will distribute the VCNet member non-emergency numbers to the Panel for review and updating; the MSDS will be removed from Tab 5 and replaced by the AAR document to be supplied by Mr. Marshall and a copy of the letter received from OSHA on emergency response entry; Tabs 6 and 7, EmTech and OHM contracts, will be moved to the back of the manual; the For-Hire Contractor checklist under Tab 8 will be removed; the VCNet Policy Statement under Tab 9 will be moved earlier in the manual; the News Release in Tab 10 will be removed; the Press Hand-out in Tab 11 will be replaced by the VCNet brochure; and, the critique blanks will be removed from Tab 12 and the call report will be sent to Panel members for review. 5.0 John Klimavicz distributed the final VCNet brochure to Committee members. The cost to Georgia Gulf for printing and copying will be reimbursed by CMA. 6.0 Lucinda Trela briefed the Committee on TRANSCAER, an industry initiative to provide resources to communities for training and development of emergency response programs. Ms. Trela will provide the Committee with a list of training programs along the vinyl chloride transfer routes. The Committee will consider making VCNet presentations at those workshops. The Committee discussed Operation Respond, an emergency response service with access to railroad databases. Currently, Operation Respond is funded by the government. In the near future, the service will be privatized. CMA is preparing a response to Operation Respond proposing the placement of the service solely in CHEMTREC to ensure it is used properly. 7.0 Carol Toth reviewed the May 24,1995 Committee letter to Edward Mazzulo of DOT on the interpretation of 49 C.F.R. 172.302 (f) which requires the marking of existing railcars to meet HM-215A requirements. In that letter, the Committee requested that DOT allow shippers to re-mark their existing cars in conjunction with their routine re-painting schedule rather than re-marking all post-October 1,1991 cars within the next twelve months. A staggered re-painting schedule would eliminate the need for a massive re-marking campaign. After reviewing the request, DOT asked for additional information. In short, DOT wants to know how many new vinyl chloride tank cars were introduced into commerce after October 1,1991 and how many old cars were re-painted after that date. After discussing DOT's request for additional information, the Committee agreed to request that DOT fully exempt all vinyl chloride tank cars from the stenciling requirement or allow shippers to stencil the appropriate shipping name on post October 1,1991, tank cars as they come in for re-painting under their normal schedules. DOT already has issued a ruling that all pre-October 1, 1991 tank cars should be re-marked at the time of their scheduled re-painting. Ms. Toth will discuss the Committee's proposal with DOT and convey DOT's response to the Committee. 8.0 The Committee letter to the American Association of Railroads regarding the ability of new vinyl chloride tank cars to accept emergency capping kits has been approved by the CMA Distribution Division and Legal Department. Dr. Shah will submit the letter to AAR. CMA is considering sending a letter supporting the Committee's recommendations to AAR. 9.0 Mr. Marshall will send disks to Committee members for collecting information on vinyl chloride railcars in use. Mr. Marshall will send a list of missing information to Dr. Shah for distribution to the Committee. 10.0 The Committee reviewed the sections of the one-day VCNet training manual. Comments were received from Formosa and PPG. The Committee agreed to remove ENVIROTIPS under the toxicology section and replace it with AAR CMA 111822 Vinyl Chloride Transportation June 6,1995 Page 4 document and a generic MSDS. On page 17 of section 5, the words "QuickConnect Coupling" will be replaced with "Coupling." Under the incident command section, the letter from OSHA on emergency response entry will be included along with an explanation of the interpretation from Ms. Toth. All comments on the manual should be sent to Dr. Shah as soon as possible. Copies of the manual will be distributed to Committee members for review prior to finalization. 11.0 The Committee discussed Vinyl Chloride Safety Awareness Training Programs. Bob Wronko will look for a location in the Niagara Falls, NY, area. Mr. Marshall indicated that a one-day training program would be useful in the Corpus Christi area. The Committee agreed to continue to use Clyde Strong and Associates as the workshop presenters. Dr. Shah will send the training manual to Clyde Strong for review. 12.0 Gerry Jordan informed the Committee that CHLOREP will hold an emergency response seminar in Boston in the fall. The seminar consists of a day and a half of lectures and workshops. The Committee may be able to schedule a vinyl chloride training session next year in conjunction with the CHLOREP seminar. Mr. Jordan will contact CHLOREP to arrange the Committee's attendance. 13.0 Dr. Shah will contact AAR to determine if the Committee can develop a training program in conjunction with AAR programs. 14.0 The Committee held an information exchange session. 15.0 Mr. Marshall briefed the Committee on issues pertaining to the Oil Pollution Act of 1990. OPA requirements will address hazardous materials as well as oil spills. Proposed requirements will be issued in January, 1996. In the first quarter of next year, the Committee will meet with a consultant, yet to be identified, to discuss the proposed requirements for hazardous material clean-ups and the course of action for the Committee. 16.0 Mr. Marshall reviewed the Phenol Safety Video and determined that a vinyl chloride video could be done in about 30 minutes. Mr. Klimavicz will send a methanol tape to Mr. Marshall for his review. Mr. Marshall and Mr. Perry will contact Vista to see if a vinyl chloride video exists there. Dr. Shah will look into the CMA video library to see if CMA has a vinyl chloride video. 17.0 Dr. Shah distributed a worksheet for calculating 1994 railcar ton miles for the purpose of prorating the 1996 budget. Committee members should complete the worksheet and send it to Mr. Benner by July 31,1995. 18.0 The Committee reviewed the topics of discussion prepared by Richard Wagner, Frank Rowland, and Mr. Wronko for a VCNet presentation at the AAR workshop. The presentation would be one and a half hours in length. The Committee will discuss the presentation at its next meeting.
