Wiley - NYO subject Visit b^OSIJA Safety and Health Compliance Officer on August 23, 1974 On August 23, 1974 at 8:30 a.m., Mr. C. F. Hacquest, Safety and Health Compliance Officer from OSHA, made an unannounced visit to the Texas City Plant to investigate the attached complaint. An informal discussion was held in John Leverton1 s office and continued at the cafeteria (Messrs. Hacquest, Deese, Leverton and Mazzolini present) until 9:40 a.m. At 9:45 a.m., we picked up Mr. J. P. Alexander and Mr. S. J. Mann . ; (Metal Trades representative) and proceeded to the Bldg. 74 area. We drove around that vicinity and pointed out the various ingress and egress paths to Bldg. 74 from Gates 1, 2, and 5. Mr. Hacquest then had a short conversation with Sam Munn and all returned to the cafeteria. After lunch, a short meeting was held at 1:00 p. m. in Mr. Engle's office (Messrs. Hacquest^ Leverton, Nickles, Mazzolini and van der Hoeven present). Mr. Hacquest reviewed the complaint and stated that there would be no citation. He felt that the complaint was not safety-motivated but was the result of the long walk from Gate 1 and enforcement of safety rules (rider limitations on trucks, short-cuts through tank areas without safety equipment, etc.). Not related to this complaint, Mr. Hacquest pointed out that similar complaints have been voiced when equal eating accommodatiohg^jwere not provided to all employees. There are no sidewalks urovided and trucks and construction vehicles are using the same street. . .1. (Continue on reverse side if necessary) Sec. 8(fXI) of the Williams-Steiger Occupational Safety and Health Act, 29 U.S.C. 651, provides as follows: Any em ployees or representative of employees who believe that a violation of a safety or health standard exists that threatens physical ham, or that an imminent danger exists, may request an inspection by giving notice to the Secretary or his author ized representative of such violation or danger. Any such notice shall be reduced to writing, shall set forth with reasonable particularity the grounds for the notice, and shall be signed by the employees ot representative of employees, and a copy shall be provided the employer or his agent no later than at the time of inspection, except that, upon request of the person giving such notice, bis name and the names of individual employees referred to therein shall nor appear in such, copy ot on- toy record published, released, or made available pursuant to subsection (g) of this section. If upon receipt of such notifica tion the Secretary determines there are reasonable grounds to believe that such violation or danger exists, he shall make a special inspection in accordance with the provisions of this section as soon as practicable, to determine if such violation r danger exists. If the Secretary determines there are no reasonable grounds to believe tfaac a violation or danger exists he hall notify the employees or representative of the employees in wricing of such determination.
