Standard on Asbestos The Asbestos Information Association (AZA) has filed
a lawsuit in the Fifth Circuit Court of Appeals challenging OSKA's issuance of an emergency temporary standard (ETS) on asbestos. As reported last week, the ETS lowers the permissible exposure limit (PEL) from 2 fibers/ec to 0.5 fibers/cc. The ETS was published in the Friday, November 4 Federal Register.
The AZA is composed of approximately fifty companies which manufacture, use, or mine asbestos. The Association has not determined whether it will seek a stay of the standard, but will make this decision by Tuesday, November 15. Ed Warren of Xirkland and Ellis is representing A1A.
