MONTREAL PROTOCOL - NATIONAL EXPERTS' MEETING 24 MAY 13:00 - 18:00 AND 25 MAY 2023, 09:30 - 18:00 ANNOTATED AGENDA 24 MAY, 13:00-18:00 Preparations regarding the Replenishment of the Multilateral Fund Report of the Technology and Economic Assessment Panel on the replenishment of the Multilateral Fund for the Implementation of the Montreal Protocol for the period 2024-2026 (decision XXXIV/2). Issues identified to initiate the discussion for the replenishment for 2024-2026 are: The need of additional/supplementary study by TEAP? Developing questions to the TEAP Positions of other donor countries/ Like Minded Meeting (elements dedicated to Replenishment) The carry-over (its impact on the replenishment process and level, thinking on how to deal with it) The FERM and UN scale Status (Level) of the MLF as of May 2023 ExCom expected discussions to be held in June at its 92nd meeting and potential implications on the replenishment process 25 MAY 09:30 - 18:00 I. Welcome and adoption of the agenda The Swedish Presidency and the Commission will welcome participants to the meeting. Any other business for the NEM meeting to be proposed at this time. The agenda will follow the Workshop and OEWG agendas, except the replenishment related agenda point 4 of the OEWG which is put at the end of the OEWG part of the agenda. 1 II. The 2022 quadrennial assessment of the Montreal Protocol (decision XXXI/2): 2 (a) Presentations and discussion on issues arising from the 2022 quadrennial assessment and synthesis reports of the Scientific Assessment Panel, the Environmental Effects Assessment Panel and the Technology and Economic Assessment Panel; Synthesis report will only be available for MOP; single Assessments Panel reports on-line There will be Q&A, as well as discussion in plenary. Prepare input as reaction to presentation synthesis reports, in particular with a strategic view to existing and future priorities for action FIN remarks that TFA conclusions are weird. They are missing the essence of the Precaution Principle. NLD also not happy with conclusions and recommendations. AUT also concerned by TFA conclusions. REACH proposal on PFAS may interact. ESP recalls that HFCs are a small part of UNFCCC emissions. (b) Information on the consumption and production of hydrofluorocarbons not listed in Annex F (decision XXIX/12); Chapter 2.11 of the MCTOC Assessment discusses this issue. It lists HFCs not included in Annex F (with a GWP threshold of 53 and higher) with commercial use. The report lists a number of other gases (HFOs, HFEs, SF6, etc.), indicating where their commercial uses are (e.g. feedstock, solvents). Inhalation anaesthetics are highlighted (e.g. desfluorane), including the EU proposal. MS to advise on any follow-up on this issue. Further info to be shared with ARNO (c) Information on the availability of hydrochlorofluorocarbons (decision XXX/2, para. 4); Art5, Group 2 countries could envisage a compliance deferral (from XXVIII/2); in this case, a mandate for a TEAP evaluation would be needed for next year, MS to advise. (d) Update to the report of the working group of the Technology and Economic Assessment Panel on information on alternatives to hydrofluorocarbons (decision XXVIII/2); Assessments online, improved to previous report on availability alternatives. (e) Potential areas of focus for the 2026 quadrennial assessment; MS to advise on content (questions, discussion items) as well as issue of aligning in the future periodic reviews and QAEU to present a CRP on future areas of focus. MS to give advice on content of such a CRP. Drafting with Group input ahead of OEWG (f) Any other issues. The report of the Technology and Economic Assessment Panel on the replenishment of the Multilateral Fund for the Implementation of the Montreal Protocol for the period 2024 - 2026 (decision XXXIV) Will be revisited at the end of the NEM on 25 May, following discussions on 24 May. 5. Strengthening Montreal Protocol institutions, including for combating illegal trade (decision XXXIV/8): (a) Outcomes of the workshop on strengthening the effective implementation and enforcement of the Montreal Protocol (UNEP/OzL.Pro.WG.1/45/6); (b) Background documents prepared by the Secretariat in accordance with decision XXXIV/8 (UNEP/OzL.Pro.WG.1/45/5, UNEP/OzL.Pro.WG.1/45/5/Add.1 and UNEP/OzL.Pro.WG.1/45/5/Add.2). Discussion of the EU objectives and priorities for a decision at the MOP, building also on the conclusions of the Stockholm workshop; Stocktake of ongoing initiatives already addressing this broader issue - the substance to be discussed under following agenda items - What are the issues not yet addressed? Timing for a potential EU CRP, or other contribution from the EU; organisation of contribution of the thematic group to be established. CION GRP3 should take this agenda item. Collect questions but also contact other Parties. 6. Energy-efficient and low- or zero-global-warming-potential technologies: (a) Report by the Technology and Economic Assessment Panel (decision XXXIV/3); Report still to come. Prepare interventions based on the TEAP report, underline best practices in the EU related to Eco-design. Consideration on issues to highlight in view of the workshop to be organised back to back with the MOP. MS to advise on follow-up next steps GER introduce their initiative paper. (b) Illegal import of certain refrigeration, air-conditioning and heat pump products and equipment (decision XXXIV/4). COM to provide an update on the EU submission; How to present in an EU intervention at the OEWG the status of the inclusion of some form of export ban in the revision of the F-gas Regulation, both co-legislators included provisions to that end differing in scope? 4 Further follow-up depends on the expected submission by the proponents. 7. Identification of gaps in the global coverage of atmospheric monitoring of controlled substances and options for enhancing such monitoring: (a) Report by the Secretariat (decision XXXIII/4); The Secretariat will report on the progress of the EU funded project; Concrete steps will be presented, flask-sampling at one location (Bangladesh) covering production sites in India, is useful; however, wish to extend geographical coverage should be a central message. (b) Report by the Technology and Economic Assessment Panel (decision XXXIV/5). Technology and Economic Assessment Panel 2023 report, including issues relating to: Report still to come (a) Nomination for critical-use exemption for methyl bromide for 2024; Canada: - has submitted a CUN for 2024 for the amount of 3,857t (approved amounts for 2023 were 4,650t and for 2022 5,017t). - MBTOC: o notes positive signs, e.g. significant decrease (17%) compared to approved amount for critical use in 2023; o commends Canada for signalling a shift towards a policy-based approach for the phase-out intent to nominate approximately 2,850 kg of MB for 2025 to not submit a nomination for 2026 requesting the grower to phase-out the use entirely, ideally by 2026. o recommends the full amount to be approved. South Africa - no nomination. Australia - no nomination - state of play to be clarified with the Party MS to give feedback on nomination(s) (b) Ongoing emissions of carbon tetrachloride (decision XXXIV/6); MS encouraged to give feedback and to advise on follow-up 5 (c) Quarantine and pre-shipment uses of methyl bromide for which alternatives are available (decision XXXIV/10, para. 4); OS secretariat has informed that: - Information on alternatives, including from TEAP's consultation with the International Plant Protection is being prepared, in line with Decision XXXIV/10 adopted at the last MOP in Montreal. - No Parties had (as yet) submitted information pursuant to paragraph 1 of Decision XXXIV/10. - Awaiting publication of the MBTOCs progress report. - In view of replenishment talks needing conclusion in 2023, EU could ask in OEWG Plenary for the topic to be put on the agenda again for the next OEWG. - MS to advice on further action (d) Existing challenges and potential options for the future configuration and function of Panel technical options committees (decision XXXIV/11, para. 1); Report on bilateral discussions on the status of the debate (e) Panel membership changes; MS are invited to report on the process of nominations of TOC members and their objectives to support the process. Two virtual and closing event. 9. Stocks of methyl bromide (decision XXXIV/10, para. 3). OS secretariat has informed that: - No Parties had (as yet) submitted information pursuant to paragraph 2 of Decision XXXIV/10. - Scope of paragraph 2 of the Decision limited only to volumes of pre-phaseout of MB stocks - Await feedback from MBTOC chair after the DDL passes - MS to advice on future relevance of this topic 10. Potential impacts of the coronavirus disease (COVID-19) pandemic on hydrofluorocarbon consumption for Group 1 parties operating under paragraph 1 of Article 5 (decision XXXIV/13).; CUBA Secretariat will report data collected from 20 plus countries; in addition to MLF data; we will need to examine data as to the "CORONA effect" 6 Cuba has submitted an adjustment proposal; MS to comment on content Role of TEAP analysis as precondition for adjustment; possibly any reference in the TEAP may be construed as such? MS to advice on EU position, also in light of impact and costs to replenishment (higher baseline) GER proposed a document. How to deal with an adjustment of the Baselines. Suggests some options POL also made a doc. They are against the CUB proposal as it would increase the replenishment. They analysed the Ger doc and prose thresholds in % in consumption. Then we should ask the ImpCom how to address this exceedance of the freeze level rather that changing the BL. They produced a table that shows which countries are concerned. Cion states that A5 may not like to be ashamed by ImpCom. -> POL if a decision allows an overshoot there is no pointing at the Party which do not need to go to ImpCom. NLD we need to assess how big is the problem and then define the strategy for resolving it. We should avoid reopening Kigali. DNK there are two financial aspects : one on the BL and one on inflation. FRA recalls that there are not many data available for the time being. FIN recalls that if no Cost Guidelines are adopted at ExCom92 there may be a bad situation for the discussion as it will defer the consideration for one year.
