Schumacher will send appropriate task groups copies of the draft product liability bill and CMA legal analyses, o The Safety Programs Task Group will detail its rationale for the rec ommendation on the EEC Seveso Directive. o The Hazard Assessment Task Group will nominate experts to the OECD and EPA Expert Group meetings. o The Product Management and Hazard Assessment Task Groups will consider commenting on EPA's TSCA Section A test rule and motion for summary judgment dealing with dioxins/furans. o Committee members will give G. Baker comments on EPA's TSCA Section A proposed rule dealing with export notification by December 20. o R. Schumacher will submit the committee's FY 86/87 Outside Services Budget request. o Committee members will give T. O'Leary comments on the paper on inter species extrapolation of carcinogenicity data by December 23. * * 4e 1. B. Karrh, chairman, convened the meeting at 8:A0 a.m. 2. The committee approved the minutes of the November 20 meeting without change. 3. Centers for Disease Control (CDC) Health-Related Authorities Members of the Health Programs Task Group attended the committee meeting to join Dr. Vernon Houk in discussing CDC's health-related authorities. Dr. Houk suggested that CMA consider exploring ways for companies to share confidential health effects information with the agency and maintain its confidentiality at the same time. Draft Product Liability Bill The committee discussed Senator Danforth's second draft product liability bill and the prospects for hearings on it in early 1986. The Public Compen sation Task Group will take the lead in analyzing scientific and policy Issues in the draft and in preparing testimony for anticipated hearings. The Health Programs Task Group and CMA's General Counsel's Group and Government Relations Department will provide their expertise to help shape the testimo ny. R. Schumacher will ensure the Health and Safety Committee and Public Compensation and Health Programs Task Groups received copies of the draft bill and CMA's legal analyses. 5. Funds for Outside Services Members of the committee took action on the following requests for funds from the FY 1985-86 budget for outside services: o Approved $17,200 to develop a CAER emergency response exercise training package, with the condition that the CAER Task Group attempt to recover development and duplication costs. o Approve $20,000 to cosponsor an emergency response exercise tele conference. o After the committee voted to suspend its rules of procedure requir ing advance notice of a request for outside services funds, it approved $15,000 to prepare public service announcements on emer gency response preparedness. o Approved $48,200 to evaluate exposure assessment methods. o Approved $2,800 to cover cost overruns for the October 1985 Neurobehavioral Workshop. The request for outside services funds for the proposal on estimating popu lation attributable risk was withdrawn pending further evaluation by the Health Programs Task Group. 6, Comments and Policy Approval The committee discussed and took action on proposed comments and policy recommendations as follows: o Referred the policy recommendation on the EEC Seveso Directive back to the Safety Programs Task Group and asked the task group to provide specific rationale for its recommendation. o Endorsed the CEFIC Principles for Safe Transfer of Technology. Health and Safety Committee Minutes of Meeting December 18, 1985 Page 4 o Approved the letter to Congressman Ritter on the Risk Assessment Research and Demonstration Act of 1985. o Delegated nominating experts to the OECD and EPA Expert Group meetings on alternative methods of acute toxicity testing to the Hazard Assessment Task Group. The committee recommended that the task group consider candidates' credentials, industry affiliation and ability to cover the costs of the meetings. o Approved the changes in TSCA Section 10 and 14 proposed by the Conservation Foundation and agreed to forward those changes to Congress through the CF Dialogue Group. o Approved the proposed approach on addressing EPA's TSCA penalty policies, with the condition that the committee review any written comments on the policies before meeting with EPA. o Approved the letter to EPA on managing health and safety informa tion reported to federal agencies. o Referred consideration of CMA comment on EPA's TSCA Section 4 test rule on dioxins/furans and of a CMA response to the Environmental Defense Fund's motion for summary judgment in EDF/NWF v, EPA (dioxins/furans) to the Product Management and Hazard Assessment Task Groups. They will review the Special Program Dioxin Panel's comments and make any recommendations on generic issues to the committee. o Agreed to provide G. Baker comments by December 20 on EPA's proposed TSCA Section 4 procedural rule dealing with export notification. The Section 4 Litigation Work Group will review members' comments and draft a CMA response to EPA's proposal. 7. Product Safety Conference The committee reviewed the conference outline prepared by the Product Manage ment Task Group, endorsed it, and recommended that the task group schedule it for September 1986 to allow for adequate planning, 8. Committee Planning Meeting Members agreed to schedule the committee planning meeting for May 7-9. The committee will invite new committee members and task group chairmen to th meeting. No Steering Task Group meeting is planned for May; the monthly committee meeting will remain scheduled for May 21. 9. FY 86/87 Outside Services Budget The committee reviewed the proposed FY 86/87 outside services budget for health and safety projects that the Steering Task Group proposal. R. FDA Conference Paper on Members of the committee received a copy to the draft paper on interspecies extrapolation of carcinogenicity data that will be presented at the FDA Conference on this subject. Members' comments on the draft are due to T. O'Leary by December 23. 11. Labeling Task Group Charter and Workplan The committee approved the Labeling Task Group's proposed charter and workplan. 12.
