Thanks for taking the time to sit in on the Skookumchuck project meeting and offering to assist in advancing the project permitting and looking into the NEPA alternative issues we discussed. Attached for your reference is the Lost Hills solar project Federal Register notice mentioned yesterday, which incorrectly notes in the no-action alternative that the ITP won't be issued and project will not be built as a result. If the Service had merely stopped at the end of the first sentence and not opined on whether or not the facility would be built they would have been fine and not exceeded their legal authority.
