Dear Doctor Kehoe: - Referring to your letter of August 24th, 1943, please be advised that this claim is Just being submitted to the Commission for consideration. It is the policy of the Commission that whenever there is a reasonable doubt concerning the relationship of a disability, or, as in this case, death, the claimant is always given the benefit of the doubt. In this case, a reasonable doubt exists that this man's death may have been the result of lead encephalitis. At least, as you state, we cannot deny the relationship. Therefore, in view of the fact that we cannot deny that death was related to his occupation, the claim will be allowed as a death claim. Proper death awards will be granted to the widow and all medical expenses of the last illness will be paid. Please consider this in formation as off the record and confidential because the Commission has not as yet heard the case. However, if the claim meets all legal requirements, that is, the employer has Workmen's Compensation coverage and claim ant was a legal resident, the claim will undoubtedly be allowed.
