Gaffey against me and against Environmental Research Foundation. John Michener told me this morning that my insurance company, Amerisure, is considering making some kind of settlement offer to Mr. Gaffey. I want to express to you in the strongest possible terms that such an offer may have dire consequences for my business. 1 am a journalist; many people know about the lawsuit by Mr. Gaffey against me. They will take it as an admission of guilt if I settle this case. Furthermore, many of the researchers named in my newsletter #171 besides William R. Gaffey might take a settlement as an invitation to sue me, since many of the statements in my newsletter could be construed to refer to persons besides Mr. Gaffey. I am not saying that settlement is out of the question. I am merely saying that I would consider it bad faith dealing by Amerisure if a settlement were offered to Mr. Gaffey without having been consulted hilly about the nature of any settlement that might be offered. To the extent that you are representing me in this case, I want to make it absolutely dear to you that I am not authorizing you under any circumstances to make a settlement offer in this case without First consulting with me about the nature and terms of the proposed settlement. I am not a person who enjoys lawsuits. This is the first one I have ever been involved in and I find it exceedingly unpleasant. Nevertheless, if my insurance company were to make a settlement offer in this case without consulting me, I would be forced to sue them for the damage that such an offer would be likely to do to my business, my self, and my organization.
