During the Opening Conference, the inspectors met with the facility's consultant, Mr. Eric Conklin, and the owner, Mr. Luke Woelber. Inspectors presented their credentials and explained that the inspection was to assess compliance with Concentrated Animal Feeding Operation (CAFO) requirements under the Clean Water Act (CWA). This inspection was conducted under the authority of Section 308 of the CWA, 33 U.S.C. 1318. Following the Opening Conference, the team conducted a site review by vehicle in the consultant's truck. For biosecurity, the inspectors wore boot covers, parked at the facility entrance, and toured the facility accompanied by the consultant. FACILITY DESCRIPTION The facility is not currently covered under an NPDES CAFO permit and is identified by NPDES ID NM0030716. At the time of the inspection, the dairy had 3,063 milking cows, 433 calves, 336 dry cows, and 2,045 heifers. Under 40 CFR 122.23, this classifies the facility as a Large CAFO. Cows are milked twice daily. The Abo Arroyo runs south of the facility, and the Rio Grande lies approximately 9 miles to the west. The facility contains two retention control structures (RCSs): RCS-1 and RCS-2 (Appendix 1, Photos 13 and 14). The settling basins are located southwest of the milking parlor, with RCS-1 and RCS-2 farther southwest. Wastewater from the milking parlor is piped to the settling basins and then flows by gravity to RCS-1 and finally to RCS-2 (Appendix 1, Photos 8-10). Both RCSs are designed as total-evaporative ponds. Site runoff is conveyed by gravity, and manure solids are provided to third parties. Section II - OBSERVATIONS Weather and Site Conditions: Weather at the time of the inspection was sunny; no precipitation had occurred in the preceding week. No active discharges were observed (Appendix 1, Photos 3 and 4). Lagoon Management: The facility operates two RCSs in its wastewater system. RCS1 is lined with 40mil HDPE. The liner was certified as properly installed by Mr. Brad J. Wieck, P.E. of EAE on July 12, 2005, based on QA/QC documentation from The Snow Company. As built in 2005, RCS1 had a total constructed capacity of 39.0 acrefeet, with 37.92 acrefeet at 2 feet of freeboard. The plan/profile shows a design surface area of 7.64 acres and notes 6.60 acrefeet of process/sludge volume. RCS-2 is lined with 60mil HDPE. Mr. Brad J. Wieck, P.E. of EAE certified the liner on July 16, 2008, after reviewing The Snow Company's QA/QC. Capacity certification for RCS-2 documents 49.48 acrefeet at the highwater level set 2 feet 2 Haw Farms, LLC/Haw Farms Inspection Date 03/04/2026 below the berm crest, with a design surface area of 5.33 acres. At the time of the inspection, both RCSs were fenced, liners appeared intact, approximately 4 feet of freeboard were observed, and no evidence of erosion or discharge was noted. The facility was actively aerating the RCSs. Open Lot Pens: The pens were in good condition, with no signs of manure buildup or stockpiles in the pens. Pens are cleaned via scraping as needed. Manure solids are stockpiled above the drainage to the RCSs (Appendix 1, Photo 11). All pens are graded and sloped to drain to the RCSs (Appendix 1, Photos 6, 14, and 15). Mortality Management Area: Animal mortalities are composted on the western perimeter of the site within the drainage of RCS-1 and RCS-2 (Appendix 1, Photo 12). Commodity Storage: The facility reports using alfalfa, corn silage, some grains, and minerals for feed. All feed commodities are stored under cover (Appendix 1, Photos 1 and 2). Land Application Sites: The facility does not land-apply wastewater; the lagoons are designed as fully evaporative. Manure solids are transferred off-site to third-party farmers, with records maintained for the transfers. Section III - AREAS OF CONCERN No areas of concern were observed during the inspection. A closing conference was conducted with the consultant, during which the observations were discussed. Inspectors left the facility at 11:00 a.m. Section IV - FOLLOW UP On March 4, 2026, at 5:17 p.m., a records request was emailed to the consultant, with a follow-up email sent on March 27, 2026, at 10:19 a.m. The consultant responded on March 27, 2026, at 10:32 a.m., providing RCS documentation.
