Thanks, Andrea Barbery Office of Intergovernmental Relations U.S. Environmental Protection Agency 202-564-1397 Notes from 11/7/17 P&P Co-Chairs Call Draft FY18-22 Strategic Plan Allison Mihalich (OCFO) gave an update on the Agency's draft FY18-19 Strategic Plan, which was open for public comments from Oct. 4 - 31. EPA received 25,000 comments, however, due to a mix-up between this docket and another open docket half of which addressed animal testing due to concurrent dockets open between EPA/OCFO and EPA/OCSPP. OCFO has developed a spreadsheet to manage the comments and will work with programs and regions to get a draft revised Plan to OMB by December 22. Meanwhile, COO Henry Darwin is working directly with program leads to set ambitious targets for the strategic measures. ECOS noted, in its comments to the draft Strategic Plan, states asked to be part of the target-setting dialogue. A number of the draft strategic measures directly impact the states, such as permitting and grant commitments. Robin Richardson (OCIR) added there is overlap between the Plan and some of EPA's Lean priority areas. EPA will review the comments and circle back with ECOS. A final Strategic Plan and associated targets for the strategic measures, will be released with the FY19 President's Budget in February. FY18-19 NPM Guidance Sierra Club v. EPA 18cv3472 NDCA Tier 10 ED 002061 00177311-00002 Kathy O'Brien (OCFO) reported out on recent discussions on the NPM Guidance process for the 2ndyear of the FY18/19 cycle. As a reminder, the 2-year NPM guidance process is a departure from annual NPM guidance process: in the first year, the Agency puts out a 2-year guidance document, and in the second year, the agency issues an addendum for significant changes. EPA worked closely with states through the NPM Guidance/NEPPS Workgroup to develop clear guidance on exceptions-based changes. FY18 is the 1st year of the FY18/19 cycle, however, there is no final FY18 budget and it is expected the FY18 appropriation will be very different from the FY18 President's Budget (the latter of which is what the Agency bases its NPM Guidances on). Given this situation, it is expected the off-year addendum may need to be more detailed than the exceptions-based format that would otherwise be expected. Complicating matters, Agency planners are referencing the FY18 budget formulation as they begin to draft the FY19 budget. Because it is clear business cannot be carried out as usual, EPA is convening the NPM/NEPPS Workgroup in the mid-December timeframe to discuss these issues and agree to a path forward. Beth Graves (ECOS) asked how states and regions will reconcile the HQ-regional negotiations, given states have already put work plans in place based on the FY18 President's Budget. OCFO responded that the HQ-Regional negotiations - also based on the FY18 PresBud - are underway, and expected to be completed by the end of December. OGD confirmed that measures are in place to allow for adjustments in states' grants, due to uncertainty stemming from the FY18 budget situation. Gerard Bulanowski (Region 8) asked if there a process in place to negotiate departures from the NPM guidances and national priorities for things that make sense for specific regional/state partnerships? OCFO responded that a key factor affecting this round of negotiations is the strategic plan, which is much more focused - having only 27 strategic measures - than strategic plans of prior years (88 measures, previously). By design, these are areas where the agency is asked to dramatically change the way it does its work. As such, these will be a top priority for EPA, and will likely impact the way EPA and the states accomplish the core work. It will be important to identify in the NPM guidances those areas where there is discretion, flexibility, and an opportunity for earlier, more meaningful discussions. Bill Ehm (Iowa) commented, states are hopeful EPA's Strategic Plan will be more outcome-based, which could result in changes to the format of the NPM guidances (e.g., fewer "beans" / more "benefit"). This would allow states the flexibility to accomplish their mission. State Grants Subgroup Julie Milazzo (OGD) reported out on the 10/26/17 meeting of the State Grants Subgroup.
