I. INTRODUCTION
CWA Section 404 Inspection - Groff September 19, 2023
A. Purpose On September 19, 2023, the U.S. Environmental Protection Agency ("EPA") conducted an inspection for compliance with Section 404 of the Clean Water Act ("CWA"). A warrant, signed by Chief United States District Judge Matthew W. Brann, authorizing entry, inspection, and sampling pursuant to the CWA was obtained to gain lawful access to the property on September 14, 2023.
All information included in this report is the result of EPA observations made during the Inspection.
Photographs were taken during the inspection by Miranda Cento and are referenced in Attachment A: Photograph Log. Not all photographs taken during the inspection may be included in the Photograph Log.
B. Site Identification The Site is identified as 100 Mill Road, Turbotville, Montour County, PA.
C. Weather and Environmental Conditions The day of the inspection was clear and sunny with temperatures in the range of 49-75 F, averaging 62 F. In the week prior to the Inspection, approximately 0.30 inches of rain was recorded at NOAA's Lock Haven Sewage Plant, PA, weather station located approximately 37.37 miles from the Site. The last recorded rainfall in the days prior to the inspection were 0.30 inches on Sep 18, 2023, as observed below in Table 1.

D. Opening Conference The EPA Inspection Team arrived on Site at approximately 9:10 AM and met with the representatives from the US Army Corps of Engineers ("USACE"), the PA Department of Environmental Protection ("PADEP"), and the US Marshals Service ("USMS"). The list of attendees is provided below in Table 2.

Approximately 5 minutes prior to arriving on Site, Miranda Cento left a voicemail for the Site owner, Arthur Groff, informing him of the Inspection, and notifying him that the Inspection Team would be arriving at the Site shortly.

II. SITE ACTIVITY
A. Use and Ownership The Property is approximately 150 acres and contains several agricultural fields and associated buildings, including a farmhouse, equipment storage sheds, barns, and storage silos. The Property is owned by Mountainside Excavators, Inc., an excavation contracting company owned and operated by Mr. Arthur Groff, who also owns a chicken farm at another nearby location. According to Mr. Groff, the Property is used to store chicken manure and to cultivate corn and soybeans. The Property is not Mr. Groff's primary residence.
B. Enforcement History On May 12, 2021, EPA conducted an inspection of the Site after the case was referred from USACE.
On July 6, 2022, a second EPA inspection ("attempted inspection") was attempted after learning of potential unauthorized activity at the Site, however, the attempted inspection was unable to be completed due to Mr. Groff's hostility and denial of access to his property.

On September 14, 2023, following the attempted inspection, EPA was granted a search warrant, signed by Chief United States District Judge Matthew W. Brann, authorizing entry, inspection, and sampling pursuant to the CWA, thus allowing EPA, USACE, and PADEP inspectors, with the accompaniment of the USMS, to gain lawful access to the property.
III. OBSERVATIONS
For simplicity and ease of understanding, "Points" (individually referred to henceforth as "P#") have been established along the route taken during the inspection. For a visual of the inspection path, see Attachment B: Site Map.
The observations made during the Inspection are summarized below.
Path from P0 - P1 The inspection walkthrough began by traversing from Point 0, the parking location, southbound along Mill Road to Point 1, the northwest corner of Wetland 19.
An active cornfield, that appeared to be treated with herbicide, was situated directly west of Mill Road (Photograph I.A). Flowing water containing algae was observed along the eastern edge of the corn field (Photographs I.B - I.D). Further south, the flowing water connected to an artificial swale situated on the northwest corner of Wetland 19 (Photograph I.E).
P1 The inspection walkthrough continued to P1: the northwest corner of Wetland 19 (Photograph II.B - II.D).
Small fish and the end of a culvert were observed in the artificial swale. Evidence of herbicide application and earth-moving activities, including tree-clearing, grubbing, and grading were observed, as Wetland 19, both east and west of the artificial swale, had been significantly disturbed and converted into an active corn field. Within the interior of the cornfield, shale fragments, adventitious roots, and a lack of tree stumps were observed (Photograph II.E - II.F).
Path from P1 - P2 The inspection walkthrough continued from P1, eastward along Mill Road.
Evidence of herbicide application and earth-moving activities, including tree-clearing, grubbing, and grading were observed as Wetland 16 had been significantly disturbed and converted into an active cornfield. Stunted corn crops were also observed within Wetland 16 (Photograph III.A- III.C).
P2 The inspection walkthrough continued to P2: the northwest corner of Wetland 16.
An excavated tributary, presenting exposed banks and wrack lines, flowing south along the western edge of Wetland 16, connected via a culvert situated under Mill Road, was observed (Photograph IV.A - IV.D). Reed canary grass (Phalaris arundinacea) and jewelweed (Impatiens

capensis) dominated the banks of the excavated tributary (Photograph IV.E). Fish were observed within the excavated tributary (Photograph IV.F - IV.G).
Evidence of herbicide application and earth-moving activities, including tree-clearing, grubbing, and grading were observed as Wetland 16 had been significantly disturbed and converted into an active cornfield. Surface water, adventitious corn (Zea mays) roots, and stunted corn crops were observed (Photograph IV.H - IV.M).
Path from P2 - P3 The inspection walkthrough continued from P2, southbound to the confluence of the excavated Wetland 16 tributary and the Railroad tributary.
Benthic invertebrates, fish, algae, wrack lines, water-stained vegetation, and floating pondweed (Potamogeton natans) were observed along the excavated tributary (Photograph V.A - V.F). Evidence of earth-moving activities, including tree-clearing, grubbing, and grading were observed as burned bits of tree stumps were found within the corn field populating Wetland 16 (Photograph V.G).
Corn crops were observed to be growing in the pipeline easement, situated directly between the southern border of Wetland 16 and the Railroad tributary. The boundary of the pipeline easement was marked by a water pipeline post (Photograph V.H - V.I).
P3 The inspection walkthrough continued to P3: the middle of the southern border of Wetland 16, in the pipeline easement. Two wetland data points ("DP#") were collected at P3.
DP1 soil profile was collected in the pipeline easement, just south of the Wetland 16 southern border, at 41.09236, -76.73045 (Photograph VI.A - VI.C), and described as: - [0-8 inches] mixed matrix, 60% 7.5YR 5/2 compacted silt soil, 30% 10YR 6/6 concentrations,
and 10% 10YR 5/1 redoximorphic features, - [8-15 inches] 100% 10YR 5/2, containing shale fragments, - [15-18 inches] mixed matrix, 70% 10YR 5/2 with 30% 7.5YR 4/6 concentrations. The soil profile met the technical definition of a hydric soil (Indicator F3). Yellow bristlegrass (Setaria parviflora) and green foxtail (Setaria viridis) dominated the herbaceous stratum (Photograph VI.D). All three parameters (i.e., vegetation, soil, and hydrology) were significantly disturbed by land clearing, grubbing, and grading.
DP2 soil profile was collected within the cornfield planted in Wetland 16 at 41.09269, -76.73004 (Photograph VI.E - VI.H) and described as: - [0-5 inches] 100% 10YR 5/2 silty soil containing many fine roots - [5-7 inches] mixed matrix, 75% 10YR 5/1 with 25% 7.5YR 4/6 redoximorphic concentrations
and oxidized rhizospheres on living roots - [7-13 inches] mixed matrix, 65% 10YR 5/1, and 35% 7.5YR 5/6 redoximorphic
concentrations and oxidized rhizospheres on living roots - [13-18 inches] mixed matrix, 50% 10YR 5/1, and 50% 10YR 5/8 redoximorphic
concentrations

Primary indicators of wetland hydrology were observed, including a high-water table and surface water at a depth of 9.5 inches from the soil surface (Photograph VI.I - VI.J). The soil profile met the technical definition of a hydric soil (Indicator F3). The corn and rough barnyard grass (Echinochloa muricata) dominated the herbaceous stratum. All three parameters (i.e., vegetation, soil, and hydrology) were significantly disturbed by land clearing, grubbing, and grading.
Path from P3 - P4 The inspection walkthrough continued from P3, southeast along the pipeline easement. Floating pondweed, fish, and mechanized tire tracks were observed (Photograph VII.A - VII.F).
P4 The inspection walkthrough continued to P4: the confluence of the Railroad tributary and the excavated Wetland 19 tributary (Photograph VIII.A).
A direct connection between the two water bodies was documented in Photograph VIII.A. Flowing water, wrack lines, algae, and plow lines were observed in the area, as well as dying and stunted corn crops within Wetland 19 (Photograph VIII.B - VIII.I).
DP3 soil profile was collected above the eastern corner of the confluence of the Railroad tributary and the Wetland 19 tributary at 41.09199, -76.728257 (Photograph VIII.J - VIII.K) and described as:
- [0-4 inches] mixed matrix: 70% 10YR 5/1 and 30% 10YR 5/6 redoximorphic concentrations with many fine roots;
- [4-7 inches] mixed matrix: 75% 10YR 5/1 and 25% 7.5YR 4/6 redoximorphic concentrations, oxidized rhizospheres on living roots, and woody debris;
- [7-10 inches] mixed matrix: 70% 10YR 5/1, 20% 7.5YR 4/6 redoximorphic concentrations, and 10% 10YR 4/1 depletion
- [10-13 inches] mixed matrix: 70% 10YR 5/1 and 30% 7.5YR 5/6 redoximorphic concentrations;
- [13-20 inches] mixed matrix, 80% 10YR 5/1 and 20% 7.5YR 5/6 redoximorphic concentrations.
The presence of reduced iron in the soil was observed through the use of Dipyridyl paper strips on the soil profile (Photograph VIII.L - VIII.M); this satisfies the presence of reduced iron (C4) indicator for wetland hydrology. Primary indicators of wetland hydrology were observed, including a high-water table and surface water at a depth of 10 inches from the soil surface (Photograph VIII.N). The soil profile met the technical definition of a hydric soil (Indicator F3). Reed canary grass (Phalaris arundinacea) dominated the herbaceous stratum. All three parameters (i.e., vegetation, soil, and hydrology) were significantly disturbed by land clearing, grubbing, and grading.

Path from P4 - P5 The inspection walkthrough continued from P4, southeast along the pipeline easement. Flowing water, wrack lines, and fish were observed (Photograph IX.A - IX.B).
P5 The inspection walkthrough continued to P5: the confluence of UNT-1 and the Railroad tributary (Photograph X.A - X.B). A direct connection between the two water bodies was documented in Photographs X.A and X.B. Wrack lines were observed along the banks of UNT-1 (Photograph X.C - X.F). Corn crops growing within the boundary of the pipeline easement, as indicated by the water pipeline post, were observed (Photograph X.G).
Path from P5 - P6 The inspection walkthrough continued from Point 5, southeast along the pipeline easement. A culvert draining water out of Wetland 8 into the Railroad tributary was observed (Photograph XI.A - B). Reed canary grass (Phalaris arundinacea) dominated the area (Photograph XI.C - XI.D). Evidence of tree-clearing in Wetland 8 was observed (Photograph XI.E - XI.G).
P6 The inspection walkthrough continued to P6: the confluence of the Railroad tributary and Beaver Run (Photograph XII.A - XII.B). A direct connection between the two water bodies was apparent.
Path from P6 - P7 The inspection walkthrough continued from P6, northwest along the pipeline easement, to where the EPA Inspection Team stopped to collect DP4.
DP4 soil profile was collected in the pipeline easement at 41.09022, -76.72417 (Photograph XIII.A - XIII.E) and described as:
- [0-4 inches] 100% 10YR 4/1 - [4-10 inches] mixed matrix: 50% 10YR 5/1 clay with 10% 2.5YR 6/1 redoximorphic
concentrations, and 20% 10YR 4/1 clay with 20% 10YR 6/6 redoximorphic concentrations; - [10-18 inches] 50% 10YR 4/1 clay, and 50% 10YR 6/6 redoximorphic concentrations.
Surface water was observed within the area (Photograph XIII.F). Soil profile met the technical definition of a hydric soil (Indicator F3). Reed canary grass (Phalaris arundinacea) dominated the herbaceous stratum. All three parameters (i.e., vegetation, soil, and hydrology) were significantly disturbed by land clearing, grubbing, and grading.
The inspection walkthrough continued from DP4, northwest along Wetland 8. A culvert draining Wetland 8, a drain line, mechanized tire tracks, wrack lines, and burned tree stumps were observed (Photograph XIII.G - XIII.K).

The inspection walkthrough continued to P7: the northwest boundary of Wetland 8. Evidence of tree clearing was apparent, as Wetland 8 was sparsely vegetated (Photograph XIV.A). Broadleaf cattail (Typha latifolia), burned tree stumps, and iron deposits in standing surface water were observed (Photograph XIV.B - XIV.E).
P8 The inspection walkthrough continued to P8: the eastern side of the confluence of the Railroad tributary and UNT-1. Flowing water, wrack lines, and stunted corn crops planted in Wetland 19 were observed (Photograph XV.A - XV.E). Evidence of herbicide application and earth-moving activities, including tree-clearing, grubbing, and grading were observed as Wetland 19 had been significantly disturbed and converted into an active cornfield.
Path from P8 - P9 The inspection walkthrough continued from P8, northward along UNT-1. Flowing water, wrack lines, and stunted corn crops planted in Wetland 19 were observed (Photograph XVI.A - XVI.C). Evidence of herbicide application and earth-moving activities, including tree-clearing, grubbing, and grading were observed as Wetland 19 had been significantly disturbed and converted into an active cornfield.
P9 The inspection walkthrough continued to P9: the midway location along UNT-1 where a culvert connects both the northern and southern extensions of UNT-1. Shale deposits, a swale containing fish, and the northern extent of UNT-1 north of the culvert were observed (Photograph XVII.A - XVII.E). Evidence of herbicide application and earth-moving activities, including tree-clearing, grubbing, and grading were observed as Wetland 19 had been significantly disturbed and converted into an active cornfield.
Posted Warrant Before concluding the Inspection and leaving the Site at approximately 1:45 PM, the EPA Inspection Team posted the Search Warrant on the barn door of the Property, located in P0 (Photograph XVI.A -XVI.B).
IV. RECORDS REVIEW
A review of Site records was not a component of the inspection; therefore, EPA is not expecting to access business records, including confidential business information ("CBI"). If the Site owner wants to make a CBI claim on information or photographs collected by the inspector during the inspection, he can submit a claim to EPA. After the Site/facility notifies EPA of the CBI, EPA representatives will mark the CBI as such, and it will be handled as CBI according to EPA's procedures.
