Environmental Protection Agency Region 4 Air Enforcement Branch 61 Forsyth Street, SW Atlanta, Georgia 30303 INSPECTION REPORT Facility Inspected Wendy's East Cherokee 3265 East Cherokee Drive Holly Springs, Georgia 30115 Inspection Date: March 29, 2023 Facility Programmatic ID 3601516764 LAT: 34.1779 LON: -84.4206 Inspection Type Clean Air Act (CAA) National Emission Standards for Hazardous Air Pollutants (NESHAP) - Asbestos Inspector Pamela Storm Introduction An inspection pursuant to Section 114 of the CAA was conducted on March 29, 2023, at Wendy's East Cherokee located at 3265 East Cherokee Drive in Holly Springs, Georgia 30115 (the facility). The unannounced inspection was conducted by Pamela Storm who possesses EPA inspector credentials to conduct CAA NESHAP asbestos inspections. The facility is a Wendy's restaurant that is being renovated. EPA received a tip regarding renovation activities ongoing at the facility. A pre-renovation asbestos inspection was conducted by S&C Limited Company on February 7, 2023, during which suspect asbestos-containing materials were sampled. Renovation activities included removing previous dining room dcor, removing the wainscoting on the walls, installing new wall and floor tiles, and installing new bathrooms and wall finishes. The EPA Region 4 CAA NESHAP asbestos program targets facilities for inspection located in the State of Georgia based on tips/complaints; permits issued on a local level; and demolition and/or renovation/abatement notices sent to the State. This inspection was conducted based on a tip/complaint. Facility Information The facility is a Wendy's restaurant that is being renovated. Inspection Inspection Upon arrival at the facility, the EPA inspector met with Mark Jarrard, Superintendent with Venture Construction Company. This contractor was on-site cleaning up the facility following renovations which had been completed. Mr. Jarrard stated that renovations began around March 6, 2023. Mr. Jarrard provided the EPA inspector with a report dated February 15, 2023, from Anderson Environmental, Inc. which included asbestos sampling CAA Asbestos Inspection Report: Inspection Date: Wendy's East Cherokee 3265 East Cherokee Drive Holly Springs, GA 30115 03/29/2023 Page 1 of 2 conducted by Calvin Timothy Anderson with S&C Limited Company. Mr. Anderson is an accredited asbestos inspector (training certificate #R22-0198-A1-0-AL-TN from CHC Training Environmental Compliance Certification Experts; expiration: February 11, 2023). The report indicated that the facility was a metal, concrete, and wood frame structure with a built-up roof. Ten samples were collected from exterior windows, the dining hall and kitchen, and the bathrooms. These samples included caulking, drywall/joint compound, wallboard, and ceiling tiles. No asbestos was detected in any of the samples. Conclusion An asbestos inspection conducted prior to the renovation of the facility, as required by 40 C.F.R. Section 61.145(a), was reviewed by the EPA inspector during this inspection. No asbestos-containing materials were identified by this asbestos survey. Therefore, this renovation appears to have been conducted in accordance with Asbestos NESHAP requirements. No follow up action is necessary.
