Farrior^ SUBJECT: OSHA Closing Conference DATE: 11/19/87 On November 18, 1987, the closing conference was held with refinery representatives and local OSHA officials to discuss the results of the recent inspection of the May 19, 1987 fatality and subsequent recordkeeping compliance review. The following personnel were in attendance: R. E. Schneck T. W. Farrior J. W. Bryant R. A. Loveless Ray Skinner Jose Chapa Marianne Magee - CRC - CRC - CRC - CRC - OSHA - OSHA - OSHA The conference began with a review of the results of the record keeping inspection and was followed by a brief discussion of the findings of the fatality investigation and subsequent recommenda tions. The first issue addressed concerned recordkeeping and dealt with the deficiencies of the Champlin Petroleum Company "Procedure for Recording and Reporting Occupational Injuries and Illnesses". The alleged shortcomings were manifested in five major areas of recordability which included issuance of pres cription medication, bone fractures, industrial illnesses (i.e. skin disorders), allergic reactions to chemicals or dust, and back injuries. In each of these categories there were as OSHA described drastic differences in the corporate guidelines and the 1978 Bureau of Labor Statistics (BLS) recordkeeping criteria. It is important to note that the 1978 BLS criteria was not used for the formulation of the corporate guidelines due to the fact that the corporate staff was not aware of its existence as was the case with many industry sectors at this time. The alleged discrepancies in our records as they pertain to the 1978 and 1986 guidelines were then highlighted. They indicated that sixty-five instances of recordkeeping errors had been for warded to BLS in Washington, D.C. and a number less than that had been returned to them which might result in citations. They did not discuss details of these cases, however, indicated that more specific information would be provided at which time citations were issued. It appears that a number between 50 and 60 alleged violations for recordkeeping have been noted. CH/W-001219 R. E. Schneck OSHA Closing Conference November 19, 1987 Page 3 As a result of this information my conclusions are as follows: 1) l feel that OSHA is attempting to allege willful intent on our part to falsify injury records due to their persistent attempts to establish good faith efforts to comply. They believe this to be true by virtue of the existence of corporate guidelines that have not been withdrawn as an official document therefore supporting their position that we did not retroactively administer BLS guidelines. This is not a factual assumption and will provide an avenue for contest. 2) The number of alleged violations is considerably higher than first thought therefore I expect that several will be contestable. I also feel that single injuries which result in multiple intermittent lost workdays will be deemed separate incidents therefore increasing both total incidents and increasing the lost workday incident rate. 3) It also appears obvious that a number of incidents cited were discovered through employee interviews. This could be significant considering that information provided to OSHA might not have been available to us for determina tion of recordability. 4) It also appears that OSHA may be seeking support for a serious citation in the fatality due to the reference to the 1979 sulfuric acid tank failure incident which also resulted in a fatality. OSHA determined 65 cases should have been recorded. 2. The number of cases was reduced somewhat by BLS - Washington. 3. Their position is felt totally substantiated by their discussions with attending physicians. 4. We were faulted for following Corporate recordkeeping guidelines instead of the official 1978 BLS guidelines (until 4/86). 5. Corporate guidelines were different from the 1978 BLS guidelines in five major ways. a. Single dose prescriptions must be recorded (OSHA). b. BLS required all bone fractures be recorded. c. Documented illnesses must be recorded, whether or not medical attention is sought. d. BLS required all allergic reactions to chemicals be recorded as an illness. e. Back injuries cannot be excluded on the basis of non-exertion. Item 5a was viewed as a minor deviation from official guidelines; Items 5b-e were considered major errors in recordkeeping policy. As an aside, OSHA strongly suggested we assure all of our pressurization stations be properly fitted with step-down regulators, and that we assure our employees (including supervision) who operate pressurized off-loading facilities be trained on-and understand--the correct procedures. This is the subject of an 11/19 memorandum to Dick Arthur and Jim Tansey. At 3:15 p.m., our conference was adjourned.
