MERRELL CHUCK McC CONVERSATION WITH MASTER CALENDAR CLERK, DISTRICT COURT May 19, 1992 Preston Bluiett, the Master Calendar Clerk of the Federal District Court, called this afternoon. He said he had in hand the 9th Circuit's Mandate dated May 6 remanding Nevada Power v. Monsanto to the District Court and the District Court's Order on Mandate dated May 14 (copies of both enclosed), and asked what he was supposed to do with them. The question took me aback, but after a little conversation I learned that he didn't know about the 9th Circuit's decision that resulted in the Mandate. I referred him to the decision, pointing out that it affirmed in part and reversed in part the court's 1989 order granting defendants' motion for summary judgment, and said that we would soon make some filings with the court, consistent with the 9th Circuit's decision, that would move the case forward. He said that was all he needed to know and that he would set the case for trial. Randall said this probably means a trial date five to six months from now. Notice from the district court of the trial setting should turn the heat up on the defendants.
