This report is based on information supplied by the facility representatives, inspector observations, port related facilities, and records including photographs taken (see Appendix 1), verbal or written statements made during or after the on-site inspection, and/or materials shown, demonstrated, or submitted to the Environmental Protection Agency (EPA) during or after the on-site inspection. In addition, information gathered prior to or after the inspection from a review of EPA, State, and public records may be included in this report. Section: 2.1 Date: 3/26/25, 08:30 AM Contains AOC: Yes Contains CBI: No I I Lead Inspector: Vince Damiano Attendees: Kristi Caton (Vice President) and Greg Stephenson (Corporate RSO) Modern American Recycling Services Inc (MARS) is located in Gibson, Louisiana, and operates as a scrap metal recycler for decommissioned offshore oil and gas platforms. The facility owns and operates supply vessels and barges that support the decommissioning and transportation of scrap metal structures. MARS also decontaminates naturally occurring radioactive material (NORM) piping brought back from offshore platforms. Decontamination is performed through a thermal heating and washing process, with the resulting solid waste managed as non-hazardous waste and sent to Sabine Environmental in Texas for disposal. Mr. Stephenson stated that MARS may collect used oil from machinery on the decommissioned platforms and transport it back to the facility for storage. He also indicated that discarded paint cans may be collected during the same operations. MARS is registered with the EPA as a Small Quantity Generator (SQG) of hazardous waste and a large quantity handler of universal waste under EPA ID LAR000027672. Following the opening conference, the inspection team conducted a visual inspection of the hazardous waste storage area, the universal waste yard and warehouse, and the used oil storage area. The inspection team first observed the hazardous waste storage area, which was storing 132 5-gallon containers, nine 1-gallon containers, and three 10-gallon containers of liquid waste. The containers ranged in capacity from full to full (see Appendix 1 - Photos 2 to 24). The contents of each container were not clear as none of the containers were labeled as hazardous waste, did not have an indication of the nature of the hazard, or an accumulation start date [AOC #1 - MARS did not clearly label containers as hazardous waste, indication of hazard, and accumulation start date - 40 CFR 262.16(b)(6)]. Some of the product labels or written labels on the containers indicated a mix of acids, corrosives, toxins, and flammable materials stored within the hazardous waste storage area, but it was unclear if these materials matched the labels on the containers; however, there was no berm or separations present in the hazardous waste storage area to separate incompatible wastes date [AOC #2 - MARS did not implement a means of separation between incompatible wastes - 40 CFR 262.16(b)(2)(v)(C)]. The inspection team also observed pallets storing paint-related materials with approximately 40 5-gallon containers, several 1-gallon containers, and several empty/dried paint containers (see Appendix 1 - Photos 24 to 37). These containers did not contain a hazardous waste label, an indication of the nature of the hazard, or an accumulation start date [see AOC #1]. Next, the inspection team observed eight full 55-gallon drums of paint-related materials. Six of which were labeled as hazardous waste and had an accumulation start date, but did not contain an indication of the hazard on the label (see Appendix 1 - Photos 1 and 38 to 49) [see AOC #1]. Four of the 55-gallon drums had an accumulation start date that were 8/06/2024, 9/24/2024, 9/25/2024, and 9/26/2024, exceeding the 180-day time limit for storage as an SQG Page 3 of 6 Modern American Recycling Services Inc. Inspection Date: 3/26/2025 (see Appendix 1 - Photos 39, 41, 47, and 49) [AOC #3 - MARS accumulated hazardous waste for more than 180 days - 40 CFR 262.16(b)]. The inspection team noted that the hazardous waste storage area drains to a sump in the middle of the right side of the building, and the sump drains directly outside of the building onto the ground (see Appendix 1 - Photos 50 and 51). Mr. Stephenson stated weekly inspections of the central accumulation area are not completed weekly [AOC #4 - MARS did not complete weekly inspections of the hazardous waste central accumulation area - 40 CFR 262.16(b)(2)(iv)]. Overview pictures, including signage indicating the Hazardous waste storage area, and views inside the area, can be seen in Photos 52 to 54. Next, the inspection team observed the laydown yard for discarded marine batteries. Mr. Stephenson stated that most of these batteries have been accumulating here for longer than one year. The inspection team was unable to determine the exact number of discarded batteries observed in the laydown yard, but the batteries are scattered across approximately one-quarter of an acre, and many were damaged and broken open (see Appendix 1 - Photos 55 to 87, 119). For the batteries that are still intact, they were not labeled as universal waste batteries, and did not contain an accumulation start date [AOC #4 - MARS did not label universal waste batteries (i.e., each battery), or a container in which the batteries are contained, with any one of the following phrases: "Universal Waste--Battery(ies)," or "Waste Battery(ies)," or "Used Battery(ies);" - 40 CFR 273.34(a)] and [AOC #5 - MARS, a large quantity handler of universal waste, did not demonstrate the length of time that the universal waste has been accumulated from the date it becomes a waste or is received - 40 CFR 273.35(c)]. Given the state and amount of batteries observed on the yard, the inspection team noted to the facility representatives that it appears they are disposing of waste without permission and acting as a disposal facility per the definition outlined in 40 CFR 260.10. Next, the inspection team entered the universal waste warehouse, where the inspection team observed approximately 25 pallets of universal waste batteries (see Appendix 1 - Photos 88 to 107, 110 to 112). The batteries observed were not labeled, and the facility was not able to demonstrate an accumulation start date at the time of the inspection [see AOC #4 and AOC #5]. For the damaged batteries, Mr. Stephenson said they were filling them with expanding foam to prevent leakage (see Appendix 1 - Photo 92). However, the damaged batteries must be contained within a receptacle to prevent any leakage or spillage [AOC #6 - MARS did not manage damaged universal waste lamps in a way that prevents spillage or leakage by using a closed, structurally sound container - 40 CFR 273.33(a)(1)]. On the shelves of the warehouse, the inspection team observed many (> 50) universal waste lamps, some of which were in open boxes, and some were left out across the warehouse (see Appendix 1 - Photos 107 to 110, 113 to 118). The universal waste lamps were unlabeled, did not display an accumulation start date, and were not stored in containers capable of containing any releases [AOC #7 - MARS did not label universal waste lamps or a container in which the lamps are contained, with any one of the following phrases: "Universal Waste--Lamp(s)," or "Waste Lamp(s)," or "Used Lamp(s)".- 40 CFR 273.34(e)] and [AOC #8- MARS, a large quantity handler of universal waste, did not manage lamps in a way that prevents releases of any universal waste or component of a universal waste to the environment- 40 CFR 273.33(d)] and [see AOC #5]. The inspection team then observed the used oil storage area, where twenty 55-gallon drums were storing used oil, and used oil with rags/PPE was observed (see Appendix 1 - Photos 120 to 135). No drums displayed "Used Oil" labels at the time of the inspection [AOC #9 - MARS did not clearly label containers used to store used oil with the words "Used Oil" - 40 CFR 279.22(c)(1)]. Next to the used oil storage area, the inspection team observed a pallet containing six half-full 5-gallon containers of sulfamic acid (see Appendix 1 - Photos 136 to 138). Mr. Stephenson stated that these are considered waste and are to be brought to the hazardous waste storage area. However, they were not labeled as such [see AOC #1]. One of the 5-gallon containers of sulfamic acid was open, pictured on the upper right in Photo 136 [AOC #10 - MARS was storing hazardous Page 4 of 6 Modern American Recycling Services Inc. Inspection Date: 3/26/2025 waste in a container that was not closed - 40 CFR 262.16(b)(2)(iii)(A)]. The inspection team did not observe other areas of concern (AOCs) at the time of the inspection. However, further EPA review may change or add to their potential AOCs. A closing conference was conducted at approximately 11:40 AM with MARS personnel. The AOCs were communicated during the closing. Following the inspection on 4/11/2025, Mr. Tony Authement sent a follow-up email in response to the AOCs observed during the inspection including: A response letter indicating the steps taken to address the AOCs observed during the inspection (Appendix 2) Photos of the hazardous waste storage area and labels on the 55-gallon drums of paint-related material (Appendix 3) Photos of universal waste battery labels on eight of the pallets inside of the universal waste warehouse (Appendix 4) Photos of used oil containers labeled (Appendix 5). MARS RESPONSE LETTER 4/11/2025 Mr Damiano In response to the list of items on the inspection at our facility on March 26, 2025 please find the following. In the waste area we have addressed the items noted. Drums have been labeled with the correct identification label showing start date and the product inside. The pictures show the 27 drums are on pallets, shrink wrapped ready for shipment. The drums have sorbent pads,oil boom,oil filters and grease. We are waiting for information for a ship date from recycler. In the waste area we also have 3-550 gallon and 9-350 gallon stainless steel totes. They have been properly labeled as used oil- non hazardous waste with the start date. The attached pictures show these containers which are also ready for the recycler to suck out and transport to their facility. In the waste area we also have 6-350 gallon and 6-550 gallon stainless steel totes that are non hazardous E&P waste. These are also labeled and dated and will be prepared for shipment to the disposal facility. The E&P totes also label the generator, the field code and the OCS-G code as per the attached pictures. The waste area also has 11- 550 gallon totes of coolant that is labeled and dated as per attached pictures. The waste storage building has 8 drums of paint that are labeled with the Hazardous Waste and flammable stickers and they are dated. We are waiting for ship date from Clean Harbor on this product. In this storage building we have 15 pallets of various 5 gallon containers with some with names and others that have to be identified. We are lining up Waste Management to send a representative to come to the facility to identify and profile this waste in order to ship it out. In March of 2024 we did the same process with waste management and shipped out a large number of container both hazardous and non-hazardous waste. Attached is the manifest for the shipment. That is the only hazardous waste that was shipped in 2024. Also attached is thee mail from Michael Eibt with Waste Management to begin this process. In the large blue ware house we currently have 8 pallets of lead acid batteries that are properly labeled with universal waste sticker and dated with start dates. They are shrink wrapped, weighed ready for shipment. We are continuing to accumulate batteries to get enough for a full load shipment. Pictures are attached. Damaged batteries are being placed in drums and labeled as hazardous waste with dates. Lamps that were noted are being put in lamp boxes, labeled and dated. These will be put on the shelf in the ware house to accumulate for shipment. The batteries that were outside of the ware house are being counted and itemized by type. We are currently working with a firm out of Maryland to recycle these batteries that are in racks and each individual battery is in a metal sleeve. Our current battery recycler will not accept these in the metal sleeves. The company in Maryland will accept them as long as they are lead acid batteries. We tried to remove them from the metal sleeves but were not too successful. A further update will be given once we conclude arrangements. The other items that were noted is a no smoking sign in the waste storage along with a fire extinguisher which is completed as per the pictures.
