Dear Sir:- In reference to letter fre.n Pennte, Davis, Earvin and Edmonds, dated October 16th, relative to latent Office action, date April 22nd, 1939, ir. the above noted case, which was for warded by Hr. L-aist October 17th:- In the course of our attorney's discussion with the Examiner who is handling this application in the Patent Office, the Examiner expressed the vie-v that "excess carbonation with compensating additions of sodium hydroxide to the anolyte" does not amount to a patentable improvement over methods of reference. Cur attorney suggests that we meet this objection by filing an affidavit setting forth the nature of the unexpected results. Before preparing this affidavit, I wish to obtain the opinion of our attorneys on the following actions:- 1. Cancel Claims jj2, Jfi, and #5. Z. Amend remaining claim, Claim "11, as follows:- Claim.:;:, jV.
