Dear Mr. Pond:
I have had the opportunity to review your letter of December 2, 1986 out lining your recommendations and the history of the claim. I agree with the recommendations you have outlined in your letter.
With respect to your first recommendation, I believe it coincides with your last recommendation. My suggestion is that we contact the state to determine if the pulmonary condition is an allowed part of this claim. If there is time enough to contest that portion of the claim, then I think a review by Dr. Dixon would be in order. However, if the state opinion is that we are beyond the statute of limitation to contest the pulmonary condition, I see no other options available other than trying to find other employment for
Ralph, your firm statement for the period November through December 1986 was forwarded to an attorney in our Legal department, Mr. Bob Bielek. Please ask your accountant to forward the workers' compensation portion of your services to my attention. This will speed up the payment of your legal fees.
Should you care to discuss this matter in greater detail, please feel free to contact me at 216-566-3095.
Sincerely,
