Neal Sidwell, Shute Creek Type and Purpose of Inspection: Compliance Evaluation Inspection Facility Type: Commercial Oilfield Waste Disposal Facility (COWDF) Applicable Statute to Inspection: RCRA Section 7003 Inspection Type: Unannounced Inspection Joint: U.S. EPA and WDEQ OPENING CONFERENCE Facility Operator: R360 Environmental Solutions General Facility and Process Description: The Shute Creek facility (Facility) is a COWDF that receives non-hazardous RCRA Subtitle C-exempt E&P oilfield waste for storage, treatment and/or disposal. The Facility has been issued a permit to operate a COWDF by WDEQ. The Facility includes four evaporation ponds, a netted slop pit, storage tanks and a tanker truck offload area. TOUR INFORMATION Upon arrival at the Facility, an opening conference was conducted with Facility representative Jared Gunter, followed by a walk-through of the Facility. During the opening conference, Mr. Gunter stated that there was oil on pond 3 (see Attachment 1 - Site Map) and that they had been having trouble getting to it due to the weather, but since it Facility Name: R360 Shute Creek LLC Facility Location: 41.868615, -110.040878 Date of Inspection: May 16, 2023 had cleared within the past week or so, they were now planning to start skimming it. Prior to the inspection, snow and muddy conditions had affected site and pond accessibility. Areas of the Facility toured: slop/skim pit evaporation ponds tank batteries tanker offload area Data Collected and Observations: During the walk-through, I observed that the netting over the slop/skim pit appeared to be in good condition with no visible holes or gaps. At the evaporation ponds, I observed oil floating on approximately 7% (estimated to be more than 5% but less than 10%) of the surface of pond 3. See Attachment 2 - Photograph Log, photo 2006. On pond 4, I observed floating oily waste on approximately 20% of the pond surface (photos 2007 and 2008), and on pond 2 approximately 5% of the pond surface (photos 2009-2011). I did not observe spills or other concerns at any other areas of the facility. CLOSING CONFERENCE During the closing conference, Mr. Gunter stated that they would use a pump and hose set to pull off the oil from the evaporation ponds and transfer it back to the slop skim pit. He also stated he thought that this material floating on ponds 2 and 4 may also be part algae.
