from OMB/OIRA on sections 4 and 5 of Executive Order 13777, "Enforcing the Regulatory
Reform Agenda." The guidance addresses the performance indicators that agencies listed in 31
U.S.C. 901(b)(1) must incorporate into their Annual Performance Plans, starting with FY 2019.
We highly recommend that agency Regulatory Policy Officers and Regulatory Reform Officers
(RRO) coordinate with their Performance Improvement Officers (PIOs) on implementing the
guidance, and recommend you send a copy of the guidance to your PIOs. In addition, thanks to
many of you who provided contact information for your agency's newly minted Regulatory
Reform Officers. I have attempted to add all of them to this email distribution, but if I missed
the RRO or your point of contact for this initiative, please forward.
The guidance also addresses the information OMB will need to consider agency requests for

waivers from EO 13777. Please note that EO 13777 applies to all agencies subject to the regulatory review requirements of EO 12866; therefore, agencies not listed in 31 U.S.C. 901(b)(1) but subject to EO 12866's regulatory review requirements must obtain a waiver if they are not to comply with the other, still applicable parts of EO 13777. We do note that several of your agencies have already submitted waiver requests. We are taking a close look at them now and hope to get back to you soon. For agencies who are planning on sending a waiver request, please send those to your agency's OIRA desk officer.
OIRA would be happy to answer any follow-up questions you may have about the guidance: it is probably most efficient to direct any questions to your OIRA desk officer.
