Section I - INTRODUCTION

PURPOSE OF THE INSPECTION
EPA Region 6 inspector Matthew Allen arrived at the CapturePoint, LLC / North Burbank Unit (NBU) 31 Battery (EPA ID No. OKU002129) at 10:45 AM on 11/14/2023 for an announced inspection. This was an EPA inspection in response to a National Response Center Spill Report (NRC No. 1383806) which was received by EPA Region 6. The inspection was conducted by the authority of the Clean Water Act (CWA) to determine compliance with Environmental Protection Agency (EPA) regulations. There was no other federal, state, or local agency representatives present at the time of the inspection.
FACILITY DESCRIPTION
EPA conducted an inspection at the CapturePoint, LLC North Burbank Unit 31 Battery, beginning near well # NBU49-31, where an equipment failure resulted in the release of a company estimated 100 barrels of saltwater. The released fluids migrated southwest along a drainage feature approximately 250 feet before spilling into the headwaters of Mud Creek.
Section II - OBSERVATIONS
I observed the release point of the spill which was well NBU 49-31. At the time of the inspection there was a workover rig present on the well. At the time of the inspection, inspector maintained a safe distance from the release point due to the ongoing well workover. NBU 49-31 and the workover rig can be seen in photo No.1 of appendix 1 (photo log) which is attached to this report. For GPS location information and additional meta data, please see the photo log.
I observed the Point of Entry (POE) into Mud Creek. At the same location I observed an elevated Total Dissolved Solids (TDS) field reading of 27,190 mg/L, this was the highest TDS reading observed during the inspection. The POE and associated field reading can be seen in Photos No. 2 and 3 of the photo log. All TDS field readings observed during the inspection were taken with a properly calibrated YSI Pro 30 Conductivity Meter.
I observed a temporary containment dam which had been placed by the operator to prevent downstream migration of impacted waters. At the same location I observed an elevated TDS field reading of 9,189 mg/L. The dam and associated TDS observation are documented in photos No. 4 and 5 of the photo log.
Continuing downstream, I observed the 2nd temporary containment dam and a TDS field reading of 18,737 mg/L. These observations can be seen in Photos No. 6 and 7.
Further downstream I observed the 3rd temporary containment dam which is documented in Photo No. 8.

I observed the 4th and final temporary containment dam which can be seen in Photo No. 9. I observed an elevated TDS field reading of 2,602 mg/L on the upstream side of the dam which can be seen in Photo No. 11. At the same location I observed the dry bed of the impacted creek behind the 4th and final dam, see Photo No. 10. There were no additional downstream spill impacts to document. During the inspection I observed 1 tank truck and operator removing elevated TDS waters from the impacted creek. I also observed a dam near the POE which was being filled with freshwater. The operator stated this dam would be removed allowing several hundred barrels of freshwater to "flush" down the impacted stream. Section III - AREAS OF CONCERN The primary areas of concern include the elevated TDS observations along the impacted section of Mud Creek from the POE to the 4th temporary containment dam. Section IV - FOLLOW UP Inspector will follow up via phone calls and site visits as needed until the impacted area is cleaned to "pre-spill" condition.
