MGPI sincerely appreciates that you are willing to work through these issues with us as we continue to work with Region 5. To that end, we want to make sure that we are collaborative with Region 5 is resolving the NOV, as we will be working with them for years to come. Our goal is to (1) resolve the NOV by settling the matter with Region 5, (2) halt any requirement for a trial study and (3) move forward with plans to build an additional warehouse on the current site facility. To meet those goals, and to maintain a solid working relationship with Region 5, MGPI is willing to commit to additional reductions through the installation of low NOX burners on the boiler, in additional to all the other reductions that have been accomplished since MGPI purchased the site. We believe that this cooperation allows Region 5 to have a "win" while also preserving the integrity of the process for whiskey aging, and allowing MGPI to move forward with plans for additional investment in Lawrenceburg. If possible, we would like to schedule a telephone conversation to provide any information or help your staff might need. Let me know if this is acceptable, and some dates and times you are available. Thank you again for your work on this, and we appreciate the goal of consistency between the regions. Sincerely, 17cv1906 Sierra Club v. EPA ED_001523_00002025-00001 Patrice Patrice Douglas Of Counsel Spencer Fane LLP 9400 N.
