Dear Mr. Lalst: I am enclosing herewith the original or ribbon copy of a proposed patent application covering a method of producing white lead which was prepared from data forwarded to you by Mr. Case with his letter of July 26th and which you forwarded to me with your letter of July 28th and in view, also, of discussions of the subject matter with Messrs. Johnson, Bowman, Knox and Stookdale on my visit to East Chioago last month. The necessary formal application papers and an assignment oonveying title to the invention covend by the application to International Smelting and Refining Company also are enclosed. This proposed application represents an effort to cover subject matter of the same general nature as that oovered by the United States patent to Johnson, Bowman and Knox No. 1,845,713 and which might have been covered to 3ome extent by a similar application filed when the application for that patent was pending if economic conditions had not been suoh as to disoourage or prohibit the filing of additional applications. Preparatory to drafting this proposed application, all of the artioles describing the white lead prooess and all other papers enclosed with your aforementioned letter were considered carefully, and the application is based ohiefly on the BUbJeot matter of the aforementioned patent No. 1,845,713 and the subject matter of a memorandum by Ur. Knox, dated August 25, 1931 and re lating to the prosecution of the application on which the patent was granted. A large proportion of the language employed was taken from the various published pamphlets prepared by the members of the staff at East Chicago. Many of the claims appearing in the draft may not be allowable and, if allowed, may not be valid. Both the non patentability and probable invalidity are sufficiently doubtful, however, to warrant their presentation, and, if they are allowed, the resulting patent should constitute a valuable addition to the patent situation covering the white lead prooess from a aommsroial or trading standpoint at least. I would suggest that the inventors consider the proposed application carefully and let me have the benefit of any sugges tions for its improvement they may wish to offer. It seemed advisable to complete the preparation of this application before completing the preparation of the apparatus ap plications for whioh data were sent also with your aforementioned letter. Dear Mr. Laist: The last time I was In New York, we discussed the subject of protecting the white lead operations and also further protecting our position with Sherwin-Williams, in connection with the possible production of Lead Chromate electrolytically. I also discussed this matter, after seeing you, with Mr. Jim Laist, and received some suggestions from him. He suggested that we send in the information in a complete form, including both the process patent material and the possible apparatus or equipment material that may also be patentable. This, we believe, has been done In the enclosed file which Mr. Johnson has forwarded. We will appreciate your referring this to Mr. McCarthy .for his consideration. By way of suggestion, I might say that the process material is probably in a form that Mr. McCarthy can obtain what he needs in order to make an application. I presume he will want to separate this and make ah application for a process patent and another for equipment patent. In connection with the equipment patent, I would like to point out that Mu*. Knox believes that the basic feature of the cathode diaphragm and frame construction described in the attached information i3 new and that it differs from the one described by Mr. Bowman in his paper given before the American Institute of Mining and Metallurgy at Salt Lake City in 1925. In thi3 connection, Mr. Knox comments as follows: ',',I'C""00SS43 N11460.04 July 26, 1937 Mr, Frederick Laist Page #2 "This improved design eliminates all contact between the cathode sheet below the solution level and the diaphragm and frame parts, while the cathode sheet of the cathode diaphragm and frame construction described in Mr, Bowman's paper is in direct contact with side tubes of the frame. This is regarded as an important feature since it has been found that lead chromate pigments and litharge can not be produced successfully in an electrolytic cell using the present standard cathode frame, but that no difficulty is experienced when the cathode frame described in this application is used." Undoubtedly the patent attornies will care to check up their own claims, but Mr. Knox's suggestions in his two claims may be in order. These are as follows; "A cathode diaphragm frame construction which accomplishes the following objectives; placing electrodes close together; elimination of electrical contact between diaphragms, electrodes, and cell walls; low electrical resistance; control of transfer by seepage of electrolytes through diaphragm; free circulation of electrolytes; elimination of gas; and collection of foreign matter. A cathode diaphragm frame construction in which the desired results are obtained by the following features; a "U" shaped frame; spacing blocks; cathode area greater than area of anode; no exposed metal fasteners below solution level; frame parts constructed of non-porous rigid insulating material; rigid "U" shaped stay rod3; selected diaphragm fabric; holes in cathode sheet at solution level; space below cathode sheets; and valve at bottom of diaphragm." The complete file enclosed consists of the following: 1, Copy of original application as submitted to attorneys for the application for the patent entitled "Single Unit Type Electrolytic Cell and Cell Assembly", and three plates with six drawings on the same, covering said application. 2.
