The facility is in a Dairy Outreach Program Area (DOPA). Inspectors met with the dairy manager, Mrs. Haily Ayers, at the Opening Conference. Inspectors presented their credentials to Mrs. Ayers and informed her that this was an EPA inspection to determine compliance with the facility's TCEQ CAFO Permit (TX0130923) and the Concentrated Animal Feeding Operations (CAFO) requirements as found in the Clean Water Act (CWA). The scope of the inspection was a full compliance evaluation and includes an evaluation of the facility's compliance with its NMP. The sequence for the inspection was an introductory overview conducted during the opening conference, followed by a site review, and an offsite records and review of the NMP paperwork. The inspectors wore boot covers, parked the washed government vehicle at the office parking lot, and toured the site in a company car for biosecurity. The consultant for the facility, Mr. Corey Mullin, joined the inspection. FACILITY DESCRIPTION The TCEQ CAFO permit (TX0130923) was issued to Miranda-Grand Canyon Dairy on 08/17/2023, and it expires in five years on 08/17/2028. The farm was evaluated for its operation and compliance with their permit requirements, as well as for the terms found in their nutrient management plan (NMP). At the time of the inspection, the dairy had roughly 1800 cows and 120 calves. The cows are milked twice daily and are kept in open lot pens between milking sessions. Holding areas are scraped then flushed with recycled wastewater twice a week. There are three domestic wastewater lagoons located in the production area: Retention Control Structure (RCS) 1, RCS 2, and RCS 3. There are also three settling basins: Settling basin (SB) 1, SB 2, and SB 3. RCS 1 and 2, as well as SB 1,2, and 3, are in the milk cow production area, which includes the milking parlor, commodity storage, open pens holding dry cows and pregnant heifers. RCS 3 is on the west end of the facility near the calf hutches. SB 1 feeds RCS 1. SB 2 and SB 3 feed RCS 2. RCS 1 and RCS 2 are in sequence. RCS 3 is for added storage and can receive wastewater from RCS 1 or RCS 2 via pumps. Wastewater is then pumped from either RCS 2 or RCS 3 for land application. Currently, wastewater is being applied to LMUs 1,2,5,5b, and 5c for 2023 and 2024 using center pivots. Slurry is being applied to LMUs 1, 10, 10b, 11,12,13,14,2,3,3a,4,5,6,8, and 9 for 2023 and 2024. All commodities are stored under cover or in silos. All records are kept on site using CAFO PRO and were digitally available when requested. 2 Section II - OBSERVATIONS Miranda-Grand Canyon Dairy Inspection Date 01-14-2025 Lagoon Management: All RCSs and SBs on site are clay lined and have a permeability rating greater than 1 X 10-7 and consist of at least 1.5' clay. There is some vegetation growing in the RCSs. RCS 2 is the last lagoon in its sequence with pole markers indicating 6' of freeboard respectively. RCS 3 poler marker indicates 5' of freeboard. All RCSs are below the 25-yr/24-hr rain event mark. The last 5-year evaluation of the liners was conducted by Norman Mullin from Enviro-Ag on 10/17/23. RCS 1 capacity is 4.04 ac/ft with 0.91 surface acres certified 03/10/10. RCS 2 capacity is 64.87 ac/ft with 9.85 surface acres certified 08/27/10. RCS 3 capacity is 25.95 ac/ft certified 08/01/07. The facility is using berms and drainage channels to route all runoff to RCS. There are some berm deficiencies on the roadways leading from the feed lanes on the north side of the facility (see Areas of Concern). Nutrient Management Plan Review: The facility has an up-to-date Nutrient Management Plan (NMP) by the consultant, Corey Mullin of Enviro-Ag. A review of the nutrient application data showed that the facility was keeping appropriate records for the amounts of nitrogen and phosphorus applied to the land application for both the lagoon process wastewater and slurry. They were also tracking the required annual soil, wastewater, and manure solids nutrient concentrations. Two fields were evaluated for agronomic rate application and both land application sites are land applying below the agronomic rate. Manure Composting: Composting is done on site in the field to the north of the pens. Berms were present around the stockpile. However, there was a manure stockpile on site outside the drainage of the RCS and without berms near SB 2 and SB 3 (see Areas of Concern). Mortality Management Area: Mortalities are buried on site. A site check of the mortality management area showed no signs of carcasses or unburied animals. Dewatering Equipment: A check of LMU center pivot showed no leaks or ponding present. Check valves were also present to prevent backflow. Section III - AREAS OF CONCERN The Miranda-Grand Canyon Dairy is well operated and maintained, with good implementation of the best management practices contained within the NMP. However, there are two areas of concern. 1) Two roads leading from the feed lanes on the north side of the property are not adequately bermed to direct runoff coming from pens to the nearby RCSs. The TCEQ CAFO general permit Part III.A.5(a)(4) 3 Miranda-Grand Canyon Dairy Inspection Date 01-14-2025 requires that "Wastewater must be contained in RCSs properly, designed, constructed, operated, and maintained according to the provisions of this general permit." 2) A manure stockpile was not in the drainage of an RCS or bermed. The TCEQ CAFO general permit Part III.A.9(b) requires that "Manure or sludge stored for more than 30 days must be stored within the drainage area of an RCS or stored in a manner (i.e. storage shed, bermed area, tarp covered area, etc.) that otherwise prevents contaminated stormwater runoff from the storage area." There were no other areas of concern observed during the inspection. A closing conference was conducted with the consultant where the areas of concern were discussed. Inspectors left the facility at 11:32 AM. Section IV - FOLLOW UP An offsite records review was conducted post inspection. All requested records requested were received by EPA R6 on 01/16/2025.
