Although significant commercial restrictions were anticipated, the Building Department's implementation of the ordinance was apparently acceptable from a builder's perspective. Accordingly, the builder did not pursue the case and although we were not happy with the situation in Pittsburgh, we did not feel that SPI was in a posture that permitted it to pursue the matter further. I am enclosing correspondence from Dale Hershey, our local counsel in Pittsburgh, noting that the case has been withdrawn by the presiding judge with the consent of the parties. Should some new situation arise in Pittsburgh that presents significant difficulties, the withdrawal of the case at hand would not prejudice our rights to seek judicial relief. know.
